A RESOLUTION SETTING OUT THE FINDINGS AND DETERMINATIONS AND ORDERING THE ESTABLISHMENT OF A SPECIAL ASSESSMENT BENEFIT DISTRICT FOR THE IMPROVEMENT OF CERTAIN DRAINAGE AND STORMWATER IMPROVEMENTS, INCLUDING THE ACQUISITION OF CERTAIN PROPERTY INTERESTS ASSOCIATED WITH THE IMPROVEMENT ON OR NEAR CERTAIN REAL PROPERTY COMMONLY KNOWN AS ORCHARDS GOLF COURSE, GENERALLY LOCATED NORTH OF WEST 15TH STREET, EAST OF LAWRENCE AVENUE, AND ORDERING SUCH IMPROVEMENT, ALL AS PROVIDED BY K.S.A. 12-6a01

 

Whereas, pursuant to the provisions of Resolution No. 6514, the governing body finds that a public hearing, pursuant to K.S.A. 12-6a01 et seq. was conducted on January 13, 2004 to determine the advisability of the following public improvement:

 

The improvement of certain drainage and stormwater improvements, including the acquisition of certain property interests associated with the improvement generally located on or near certain real property, commonly known as Orchards Golf Course, generally located north of West 15th Street, east of Lawrence Avenue, and related improvements thereto.  The improvement shall include the acquisition of drainage easements and a conservation easement on the Orchards Golf Course that shall limit the future development of that property and reduce the future expansion of impervious surface on that property.

 

Whereas, notice of such hearing was duly published as required by law.

 

Whereas, the governing body does hereby does find and determine, in accordance with K.S.A. 12-6a01 et seq., all as hereinafter set forth;

 

NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

SECTION I.  That the Governing Body hereby finds, and finally determines, that it is advisable to make the following improvements:

 

(a)      The general nature of the proposed improvement:

 

The improvement of certain drainage and stormwater improvements, including the acquisition of certain property interests associated with the improvement generally located on or near certain real property, commonly known as Orchards Golf Course, generally located north of West 15th Street, east of Lawrence Avenue, and related improvements thereto. The improvement shall include the acquisition of drainage easements and a conservation easement on the Orchards Golf Course that shall limit the future development of that property and reduce the future expansion of impervious surface on that property.

 (b)   The proposed improvement district shall consist of the following tracts, to-wit:

(c)     The estimated or probable cost of the improvement:  $450,000.00

 

(d)    The method of assessment:  Each lot and parcel in the improvement district shall be assessed based on a ratio of the appraised value of each lot and parcel in the improvement district to the appraised values of all of the lots and parcels of the entire improvement district; provided, however, that because of the location, size and configuration of Tract No. 55, only 15% only 15%_______% of the appraised value of Tract No. 55 shall be included in the calculation of assessments as described herein. The appraised value shall be that appraised value as determined by the Office of County Appraiser of Douglas County, Kansas, as of December 1, 2003.

(e)    The apportionment of costs:  The improvement district shall pay up to and including $280,000 and the City at-large shall pay the remainder of the costs.

SECTION II.  The improvement is hereby authorized and ordered to be made in accordance with the findings of the governing body upon the advisability of the improvement.

SECTION III. The City may adopt an ordinance establishing the maximum amount of special assessments prior to the acquisition and/or construction of the improvement, all as provided by K.S.A. 12-6a09, as amended.

 

SECTION IV.            The City expects to make capital expenditures after the date of this Resolution in connection with the improvements described herein and intends to reimburse itself for such expenditures with the proceeds of bonds and/or notes in the maximum principal amount of $450,000, plus costs of issuance and plus costs of interest on any temporary financing.

            The improvement shall not be commenced if, within 20 days after publication of this resolution, written protest signed by both 51% or more of the resident owners of record of property within the improvement district and the owners of record of more than half of the total area of said district are filed with the City Clerk.  Twenty-one days after the publication of this resolution, Resolution No. 6457 is repealed.

            This resolution shall be come effective upon its publication in the official city newspaper.
