RE:                 Sheridan’s Frozen Custard Street Vendor License

Duke Frye of Frye Enterprises Inc. (d/b/a Sheridan’s Frozen Custard) has submitted a street vendor application to sell frozen custard, drinks, and possibly hot dogs at the southwest corner of 9th and Massachusetts during the months of April through October.  I have reviewed the application and it contains all of the Code Section 6-1403 requirements; namely, approval of all businesses within 75 feet of the location (Weaver’s Department Store); proof of current liability insurance; and a Kansas retail sales tax number.  Photographs of a cart similar to that proposed for this location are attached.  The applicant has also submitted a copy of the 2004 certificate from the Kansas Department of Health and Environment as required in Code section 6-1406(B). 

 

The applicant has not decided yet whether to sell hot dogs at the location.  If hot dogs will be sold, a heating device will need to be inspected by the Fire/Medical Department.  Rich Barr, Fire Marshall, has approved the application conditioned on a Fire/Medical Department inspection before the applicant can use any heating devices as required by Code Section 6-1406.

 

The applicant received a copy of Chapter 6 of the City Code and has signed the application noting that he agrees to abide by all requirements including understanding that any signs must conform to Downtown Design Guidelines and shall be approved by the Historic Resources Commission. 

 

We are requesting that the application be placed on the February 24, 2004 Consent Agenda and that the City Commission approve the street vendor application for the southwest corner of 9th & Massachusetts
