ORDINANCE NO. 7711
AN ORDINANCE PROVIDING FOR THE REZONING OF APPROXIMATELY 23.9380 ACRES FROM A (AGRICULTURAL) DISTRICT TO RMD (DUPLEX RESIDENTIAL) DISTRICT, AS HEREINAFTER SET FORTH, AND AMENDING THE ZONING DISTRICTS MAP INCORPORATED BY REFERENCE IN CHAPTER 20, ARTICLE 5, SECTION 501, OF THE “CODE OF THE CITY OF LAWRENCE, KANSAS, 2003,” AND AMENDMENTS THERETO.
WHEREAS, after due and lawful notice and hearing, the Lawrence-Douglas County Metropolitan Planning Commission on September 24, 2003, recommended with conditions that the zoning classification for the tract of land described in Section II of this ordinance all within the City of Lawrence, Douglas County, Kansas, be changed from A (Agricultural) District to RMD (Duplex Residential) District.
WHEREAS, after due and lawful notice the zoning recommendation came on for hearing before the governing body of the City of Lawrence, Douglas County, Kansas on October 14, 2003, and after due consideration and deliberation the recommended zoning change was approved, subject to the conditions of annexation and final plat approval of the property.
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:
SECTION I. The above stated recitals are by reference incorporated herein, and shall be as effective as if repeated verbatim.
SECTION II. That the zoning district classification for the following described tract of land situated in the City of Lawrence, Douglas County, Kansas, to-wit:
A TRACT OF LAND IN THE NORTH 60 ACRES OF THE EAST HALF THE NORTHEAST QUARTER OF SECTION 8, TOWNSHIP 13 SOUTH, RANGE 20 EAST OF THE 6TH P.M. IN DOUGLAS COUNTY, KANSAS, DESCRIBED AS FOLLOWS:
BEGINNING AT THE NORTHWEST CORNER OF THE EAST HALF OF SAID NORTHEAST QUARTER; THENCE NORTH 87°52'26" EAST, ALONG THE NORTH LINE OF SAID NORTHEAST QUARTER, A DISTANCE OF 320.01 FEET; THENCE SOUTH 01°36'32" EAST, ALONG A LINE PARALLEL WITH THE WEST LINE OF THE EAST HALF OF SAID NORTHEAST QUARTER, A DISTANCE OF 758.35 FEET; THENCE SOUTH 39°33'45" EAST, A DISTANCE OF 419.33 FEET; THENCE SOUTH 26°55'47" EAST, A DISTANCE OF 306.17 FEET; THENCE ALONG A CURVE TO THE LEFT 5.26 FEET, SAID CURVE HAS A RADIUS OF 1,000 AND A CHORD WHICH BEARS NORTH 64°44'24" EAST, A DISTANCE OF 5.26 FEET; THENCE NORTH 64°35'21" EAST, A DISTANCE OF 21.37 FEET; THENCE ALONG A CURVE TO THE RIGHT 424.00 FEET, SAID CURVE HAS A RADIUS OF 1,000 AND A CHORD WHICH BEARS NORTH 76°44'09" EAST A DISTANCE OF 420.83 FEET; THENCE NORTH 88°52'57" EAST A DISTANCE OF 169.56 FEET TO THE EAST LINE OF THE NORTHEAST QUARTER OF SAID NORTHEAST QUARTER; THENCE SOUTH 01°36'53" EAST, ALONG THE EAST LINE OF THE NORTHEAST QUARTER OF SAID NORTHEAST QUARTER, A DISTANCE OF 40.00 FEET TO THE SOUTHEAST CORNER THEREOF; THENCE SOUTH 01°37'18" EAST, ALONG THE EAST LINE OF SAID NORTHEAST QUARTER, A DISTANCE OF 361.02 FEET; THENCE SOUTH 87°49'52" WEST, ALONG A LINE PARALLEL WITH THE SOUTH LINE OF THE NORTH 60 ACRES OF THE EAST HALF OF SAID NORTHEAST QUARTER, A DISTANCE OF 584.87 FEET; THENCE SOUTH 02°10'08" EAST A DISTANCE OF 152.17 FEET; THENCE SOUTH 87°49'52" WEST, PARALLEL WITH THE SOUTH LINE OF SAID NORTH 60 ACRES, A DISTANCE OF 580.14 FEET; THENCE NORTH 02°10'08" WEST A DISTANCE OF 130.71 FEET; THENCE NORTH 87°49'52" EAST A DISTANCE OF 140.00 FEET; THENCE NORTH 02°10'08" WEST A DISTANCE OF 255.00 FEET; THENCE SOUTH 87°49'52" WEST A DISTANCE OF 287.65 FEET TO THE WEST LINE OF THE EAST HALF OF SAID NORTHEAST QUARTER; THENCE NORTH 01°36'32" WEST A DISTANCE OF 1448.88 FEET TO THE POINT OF BEGINNING, CONTAINING 1,042,738 SQUARE FEET OR 23.9380 ACRES MORE OR LESS.
be and the same is hereby changed from that of A (Agricultural) District to RMD (Duplex Residential) District as such district is defined and prescribed in Chapter 20 of the “Code of the City of Lawrence, Kansas, 2003,” and amendments thereto.
SECTION III. That the Zoning Districts Map incorporated by reference in and by Chapter 20, Article 5, Section 501, of the “Code of the City of Lawrence, Kansas, 2003,” be and the same is hereby amended by showing and reflecting thereon the new zoning district classification for the aforesaid tract, as set forth in Section II of this ordinance.
SECTION IV. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
