                                                ORDINANCE NO. 7712

 

AN ORDINANCE PROVIDING FOR THE REZONING OF APPROXIMATELY 8.6220 ACRES FROM A (AGRICULTURAL) DISTRICT TO RS-2 (SINGLE-FAMILY RESIDENCE) DISTRICT, AS HEREINAFTER SET FORTH, AND AMENDING THE ZONING DISTRICTS MAP INCORPORATED BY REFERENCE IN CHAPTER 20, ARTICLE 5, SECTION 501, OF THE “CODE OF THE CITY OF LAWRENCE, KANSAS, 2003,” AND AMENDMENTS THERETO.

 

WHEREAS, after due and lawful notice and hearing, the Lawrence-Douglas County Metropolitan Planning Commission on September 24, 2003, recommended with conditions that the zoning classification for the tract of land described in Section II of this ordinance all within the City of Lawrence, Douglas County, Kansas, be changed from A (Agricultural) District to RS-2 (Single-Family Residence) District.

 

WHEREAS, after due and lawful notice the zoning recommendation came on for hearing before the governing body of the City of Lawrence, Douglas County, Kansas on October 14, 2003, and after due consideration and deliberation the recommended zoning change was approved, subject to the conditions of annexation and final plat approval of the property.

 

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

SECTION I.  The above stated recitals are by reference incorporated herein, and shall be as effective as if repeated verbatim.

 

SECTION II.  That the zoning district classification for the following described tract of land situated in the City of Lawrence, Douglas County, Kansas, to-wit:

 

A TRACT OF LAND IN THE NORTH 60 ACRES OF THE EAST HALF OF THE NORTHEAST QUARTER OF SECTION 8, TOWNSHIP 13 SOUTH, RANGE 20 EAST OF THE 6TH P.M. IN DOUGLAS COUNTY, KANSAS, DESCRIBED AS FOLLOWS:

 

BEGINNING AT THE SOUTHEAST CORNER OF SAID NORTH 60 ACRES; THENCE SOUTH 87°49'52" WEST, ALONG THE SOUTH LINE OF SAID NORTH 60 ACRES, A DISTANCE OF 1315.01 FEET TO THE SOUTHWEST CORNER THEREOF; THENCE NORTH 01°36'32" WEST, ALONG THE WEST LINE OF THE EAST HALF OF SAID NORTHEAST QUARTER, A DISTANCE OF 532.74 FEET; THENCE NORTH 87°49'52" EAST A DISTANCE OF 287.65 FEET; THENCE SOUTH 02°10'08" EAST, A DISTANCE OF 255.00 FEET; THENCE SOUTH 87°49'52" WEST A DISTANCE OF 140.00 FEET; THENCE SOUTH 02°10'08" EAST A DISTANCE OF 130.71 FEET; THENCE NORTH 87°49'52" EAST A DISTANCE OF 580.14 FEET; THENCE NORTH 02°10'08" WEST A DISTANCE OF 152.17 FEET; THENCE NORTH 87°49'52" EAST A DISTANCE OF 584.87 FEET TO THE EAST LINE OF SAID NORTHEAST QUARTER; THENCE SOUTH 01°37'18" EAST A DISTANCE OF 299.19 FEET TO THE POINT OF BEGINNING, CONTAINING 375,573 SQUARE FEET OR 8.6220 ACRES MORE OR LESS.

 

be and the same is hereby changed from that of A (Agricultural) District to RS-2 (Single-Family Residence) District as such district is defined and prescribed in Chapter 20 of the “Code of the City of Lawrence, Kansas, 2003,” and amendments thereto.

 

SECTION III.  That the Zoning Districts Map incorporated by reference in and by Chapter 20, Article 5, Section 501, of the “Code of the City of Lawrence, Kansas, 2003,” be and the same is hereby amended by showing and reflecting thereon the new zoning district classification for the aforesaid tract, as set forth in Section II of this ordinance.

 

SECTION IV.  This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
