Date:  May 6, 2004

Attached please find a request from Greg Seibel, Project Manager of the University Student Housing Association (UKSHA) house moving project (1309 Ohio).  Please note that he is requesting from the City Commission a waiver of house moving charges as follows:

o  Value of eight (8) trees removed along the City’s right of way to accommodate the move - $11,790.74 (includes deduction of $2500 deposit from UKSHA)

Additionally, I have attached:

·        a memo from Mark Hecker, Parks & Maintenance Superintendent, addressing Mr. Seibel’s concerns

·        copy of the Site Plan Review and staff recommendations;

·        copy of a letter from the Planning department to the property owners, James and Nancy Dunn (copied 10/29/03 to Greg Seibel);

·        copy of the pertinent section of the code dealing with damages as a result of structure moves (Chapter 16, article 7, pg. 16-20)

·        copy of an e-mail from Candice Davis, ONA President, supporting the waiver of charges

Action Item

Mr. Seibel is requesting consideration by the City Commission of a waiver of the charge for the value of the trees ($11,790.74).  It is assumed that if the City Commission opts to waive the tree value charges, the $2,500 deposit will be refunded to the UKSHA.
