Re:     Ordinance Concerning the Sale of Tobacco Products to Minors

Attached is an ordinance enacting Chapter 9, Article 8A concerning the sale of cigarettes and tobacco products to, and the purchase and possession of the same by, persons under the age of 18.  Staff recommends the adoption of this ordinance in the event Ordinance No. 7782 (restricting smoking in public places) is adopted.   By enacting the attached ordinance the prohibition against selling or providing cigarettes or tobacco products to persons under the age of 18 and the prohibition against purchasing or possessing such products by persons under the age of 18 will remain in the City Code if Ordinance No. 7782 is subsequently repealed pursuant to the initiative and referendum statute, K.S.A. 12-3013.
