Re:            Orchards Golf Course

The draft Conservation Easement has been revised several times and City Commission review and approval is appropriate.  The Easement has been reviewed and approved by the Orchards benefit district steering committee, and the contract purchase property owners have also indicated their approval. Key sections of the easement include those prohibiting certain uses (Section 3 ) and specifically allowing certain uses (Section 4 ).  As previously discussed, it is the general intent of the drafters to allow  current golf course usage to continue, but strictly prohibit any future development of the property.   Jack Skeels and City staff are assembling the necessary attachments.  The pending property owners have also agreed to execute appropriate drainage easements for the property.

With Commission concurrence in the Conservation Easement, we can proceed to schedule a closing date for the acquisition of the easement for $280,000.
