ORDINANCE NO. 7713
AN ORDINANCE PROVIDING FOR THE REZONING OF APPROXIMATELY 7.1054 ACRES PLUS ADJACENT RIGHT-OF-WAY FROM A (AGRICULTURAL) DISTRICT TO O-1 (OFFICE) DISTRICT, AS HEREINAFTER SET FORTH, AND AMENDING THE ZONING DISTRICTS MAP INCORPORATED BY REFERENCE IN CHAPTER 20, ARTICLE 5, SECTION 501, OF THE “CODE OF THE CITY OF LAWRENCE, KANSAS, 2003,” AND AMENDMENTS THERETO.
WHEREAS, after due and lawful notice and hearing, the Lawrence-Douglas County Metropolitan Planning Commission on September 24, 2003, recommended with conditions that the zoning classification for the tract of land described in Section II of this ordinance all within the City of Lawrence, Douglas County, Kansas, be changed from A (Agricultural) District to O-1 (Office) District.
WHEREAS, after due and lawful notice the zoning recommendation came on for hearing before the governing body of the City of Lawrence, Douglas County, Kansas on October 14, 2003, and after due consideration and deliberation the recommended zoning change was approved, subject to the conditions of annexation and final plat approval of the property.
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:
SECTION I. The above stated recitals are by reference incorporated herein, and shall be as effective as if repeated verbatim.
SECTION II. That the zoning district classification for the following described tract of land situated in the City of Lawrence, Douglas County, Kansas, to-wit:
A TRACT OF LAND IN THE NORTH 60 ACRES OF THE EAST ONE-HALF OF THE NORTHEAST QUARTER OF SECTION 8, TOWNSHIP 13 SOUTH, RANGE 20 EAST OF THE 6TH P.M. IN DOUGLAS COUNTY, KANSAS, DESCRIBED AS FOLLOWS:
BEGINNING AT THE NORTHEAST CORNER OF SAID SECTION 8; THENCE SOUTH 01°36'53" EAST, ALONG THE EAST LINE OF THE NORTHEAST QUARTER OF SAID NORTHEAST QUARTER, A DISTANCE OF 595.00 FEET; THENCE SOUTH 88°23'07" WEST, A DISTANCE OF 64.62 FEET; THENCE ALONG A CURVE TO THE RIGHT 161.75 FEET, SAID CURVE HAS A RADIUS OF 300.00 FEET AND A CHORD WHICH BEARS NORTH 76°10'06" WEST A DISTANCE OF 159.80 FEET; THENCE NORTH 60º43'19" WEST, A DISTANCE OF 82.58 FEET; THENCE ALONG A CURVE TO THE LEFT 98.43 FEET, SAID CURVE HAS A RADIUS OF 300.00 FEET AND A CHORD WHICH BEARS NORTH 70º07'17" WEST, A DISTANCE OF 97.99 FEET; THENCE NORTH 79º31'15" WEST, A DISTANCE OF 19.75 FEET; THENCE SOUTH 88°23'07" WEST A DISTANCE OF 100.00 FEET; THENCE NORTH 39°04'53" WEST A DISTANCE OF 181.82 FEET; THENCE NORTH 02°32'34" WEST A DISTANCE OF 320.24 FEET TO THE NORTH LINE OF THE EAST HALF OF SAID NORTHEAST QUARTER; THENCE NORTH 87°52'26" EAST, ALONG THE NORTH LINE OF THE EAST HALF OF SAID NORTHEAST QUARTER, A DISTANCE OF 615.81 FEET TO THE POINT OF BEGINNING. CONTAINING 309,512 SQUARE FEET OR 7.1054 ACRES, MORE OR LESS.
be and the same is hereby changed from that of A (Agricultural) District to O-1 (Office) District as such district is defined and prescribed in Chapter 20 of the “Code of the City of Lawrence, Kansas, 2003,” and amendments thereto.
SECTION III. That the Zoning Districts Map incorporated by reference in and by Chapter 20, Article 5, Section 501, of the “Code of the City of Lawrence, Kansas, 2003,” be and the same is hereby amended by showing and reflecting thereon the new zoning district classification for the aforesaid tract, as set forth in Section II of this ordinance.
SECTION IV. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
