                                                ORDINANCE NO. 7773

 

AN ORDINANCE PROVIDING FOR THE REZONING OF APPROXIMATELY 20.1309 ACRES FROM A (AGRICULTURAL) DISTRICT TO PRD-2 (PLANNED RESIDENTIAL DEVELOPMENT) DISTRICT, AS HEREINAFTER SET FORTH, AND AMENDING THE ZONING DISTRICTS MAP INCORPORATED BY REFERENCE IN CHAPTER 20, ARTICLE 5, SECTION 501, OF THE “CODE OF THE CITY OF LAWRENCE, KANSAS, 2003,” AND AMENDMENTS THERETO.

 

WHEREAS, after due and lawful notice and hearing, the Lawrence-Douglas County Metropolitan Planning Commission on March 3, 2004, recommended that the zoning classification for the tract of land described in Section II of this ordinance all within the City of Lawrence, Douglas County, Kansas, be changed from A (Agricultural) District to PRD-2 (Planned Residential Development) District, subject to conditions.

 

WHEREAS, after due and lawful notice the zoning recommendation came on for hearing before the governing body of the City of Lawrence, Douglas County, Kansas on April 13, 2004, and after due consideration and deliberation the recommended zoning change was approved, subject to conditions.

 

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

SECTION I.  The above stated recitals are by reference incorporated herein, and shall be as effective as if repeated verbatim.

 

SECTION II.  That the zoning district classification for the following described tracts of land situated in the City of Lawrence, Douglas County, Kansas, to-wit:

 

A TRACT OF LAND IN THE NORTH 60 ACRES OF THE EAST HALF THE NORTHEAST QUARTER OF SECTION 8, TOWNSHIP 13 SOUTH, RANGE 20 EAST OF THE SIXTH PRINCIPAL MERIDIAN IN DOUGLAS COUNTY, KANSAS DESCRIBED AS FOLLOWS:

 

COMMENCING AT THE NORTHEAST CORNER OF SAID NORTHEAST QUARTER; THENCE SOUTH 01°36’53 EAST, ALONG THE EAST LINE OF THE NORTHEAST QUARTER OF SAID NORTHEAST QUARTER, A DISTANCE OF 595.00 FEET TO THE POINT OF BEGINNING; THENCE CONTINUE SOUTH 01°36’53” EAST, ALONG THE EAST LINE OF THE NORTHEAST QUARTER OF SAID NORTHEAST QUARTER, A DISTANCE OF 685.42 FEET; THENCE SOUTH 88°52’57” WEST A DISTANCE OF 169.43 FEET; THENCE ALONG A CURVE TO THE LEFT 424.00 FEET, SAID CURVE HAS A RADIUS OF 1,000.00 FEET AND A CHORD WHICH BEARS SOUTH 76°44’09” WEST A DISTANCE OF 420.83 FEET; THENCE SOUTH 64°35’21 WEST, A DISTANCE OF 21.37 FEET; THENCE ALONG A CURVE TO THE RIGHT 5.26 FEET, SAID CURVE HAS A RADIUS OF 1,000.00 FEET AND A CHORD WHICH BEARS SOUTH 64°44’24 WEST A DISTANCE OF 5.26 FEET; THENCE NORTH 26°55’47” WEST A DISTANCE OF 306.17 FEET; THENCE NORTH 39°33’45” WEST A DISTANCE OF 419.33 FEET; THENCE NORTH 01°36’32” WEST A DISTANCE OF 758.35 FEET TO THE NORTH LINE OF THE EAST HALF OF SAID NORTHEAST QUARTER; THENCE NORTH 87°52’26” EAST ALONG THE NORTH LINE OF THE EAST HALF OF SAID NORTHEAST QUARTER, A DISTANCE OF 378.89 FEET; THENCE SOUTH 02°32’34” EAST A DISTANCE OF 320.24 FEET; THENCE SOUTH 39°04’53” EAST A DISTANCE OF 181.82 FEET; THENCE NORTH 88°23’07” EAST A DISTANCE OF 100.00 FEET; THENCE SOUTH 79°31’15” EAST A DISTANCE OF 19.75 FEET; THENCE ALONG A CURVE TO THE RIGHT 98.43 FEET, SAID CURVE HAS A RADIUS OF 300.00 FEET AND A CHORD WHICH BEARS SOUTH 70°07’17” EAST, A DISTANCE OF 97.99 FEET; THENCE SOUTH 60°43’19” EAST, A DISTANCE OF 82.58 FEET; THENCE ALONG A CURVE TO THE LEFT A DISTANCE OF 161.75 FEET, SAID CURVE HAS A RADIUS OF 300.00 AND A CHORD WHICH BEARS SOUTH 76°10’06” EAST, A DISTANCE OF 159.80 FEET; THENCE NORTH 88°23’07” EAST, A DISTANCE OF 64.62 FEET TO THE POINT OF BEGINNING, CONTAINING 876,904 SQUARE FEET OR 20.1309 ACRES, MORE OR LESS.

 

 

be and the same are hereby changed from that of A (Agricultural) District to PRD-2 (Planned Residential Development) District as such district is defined and prescribed in Chapter 20 of the “Code of the City of Lawrence, Kansas, 2003,” and amendments thereto.

 

SECTION III.  That the Zoning Districts Map incorporated by reference in and by Chapter 20, Article 5, Section 501, of the “Code of the City of Lawrence, Kansas, 2003,” be and the same is hereby amended by showing and reflecting thereon the new zoning district classification for the aforesaid tract, as set forth in Section II of this ordinance.

 

SECTION IV.  This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
