TEMPORARY USE PERMITTED UPON REVIEW

TUPR-06-20-04: A request for a Temporary Use Permitted upon Review for a fundraising event for the Boys and Girls Club. The event will be held on the Meadowbrook property located at the northeast corner of Crestline Drive and W. 15th Street on Saturday, July 17th from 5:00pm – 11:30pm. Current Zoning and Land Use: RM-3 (Multiple-Family Residence District) with PUD Overlay; open lawn area at Meadowbrook Apartment complex.
Staff Recommendation: Planning staff recommends approval of the site plan subject to the following conditions:
1. Compliance with the Historic Resources Commission conditions of approval: (a)The applicant provide detailed information on how the new construction will be attached to the historic structure; (b)the applicant work with the Architectural Review Committee to explore roof options and determine final roof selection; and (c) the applicant provide complete construction documents with material notations to be reviewed and approved by the Historic Resources Administrator prior to release of a building permit.
2. Execution of a site plan performance agreement per Section 20-1433.
3. Provision of a revised site plan to include the following changes:
(a) Provision of a note on the face of the site plan indicating the Historic Resources Commission approval of DR-04-33-04 on May 20, 2004 subject to conditions
(b) Correct dimension notations.
(c) Show exiting utilities per Section 20-1431.
(d) Correct Impervious Surface Table.
(e) Identify material for sidewalk on east side of structure.
(f) Identify dimensions of planters located on east side of structure.
(g) Identify species of trees in landscaping notes.
(h) Identify net square footage.
(i) Provide lighting information including mounting height and fixture type.
(j) Identify utility access and utility pole.
(k) Correct general note 1.2 to specify use.
(l) Identify all lines on plan with correct dimensions or notations.
(m) Identify property lines.
(n) Change the title block to include “Rear Patio/Deck Addition.”
STAFF REVIEW
The request is for a Temporary Use Permitted Upon Review for a fundraising event for the Boys and Girls Club on Saturday, July 17th. The evening event will be held from 5:00pm to 11:30pm on the grassy lawn at the Meadowbrook apartments located at the northeast corner of Crestline Drive and W. 15th Street. City Commission approval is necessary in order to sanction the temporary liquor license application that is needed to accommodate the distribution of beer at this fundraising event.
The applicant proposes to erect a temporary fence east of Crestline Drive to enclose the event area. A temporary stage and tents will be erected for the event. Parking will be provided on the grassy area east and south of the fenced area. The applicant anticipates between 200 – 400 attendees. If needed, overflow parking will be available on the grassy area west of Crestline Drive. The applicant will need to monitor the area to keep the alcohol within the ‘event area’. State license approval is necessary to serve beer in this area.
The tent must be flame retardant, a fire extinguisher must be provided and “No Smoking” signs must be posted. Additionally, any signs displayed in conjunction with the event shall comply with the City sign regulations and shall not be located on public right-of-way. Temporary sign permits must be obtained.
A similar event was held the last two summers as a fundraiser for the Boys and Girls Club. No negative impacts were reported after that event.
TUPR Request
Per Section 20-1454.5 of the Zoning Ordinance, the request is classified as a Temporary Use, which does not meet the criteria for administrative approval. The Meadowbrook site is residentially zoned which requires City Commission approval to permit the applicant to submit a request for a temporary liquor license to the Kansas Department of Revenue, Alcoholic Beverage Control Division. In Staff's opinion, all conditions outlined in 20-1454.5 have been addressed.
Recommendation: Planning Staff recommends approval of the request for a Temporary Use Permitted upon Review for a fundraising event for the Boys and Girls Club.
