ORDINANCE NO. 7800
AN ORDINANCE PROVIDING FOR THE REZONING OF APPROXIMATELY 4.07 ACRES FROM A (AGRICULTURAL) DISTRICT TO RS-2 (SINGLE-FAMILY RESIDENTIAL) DISTRICT, AS HEREINAFTER SET FORTH, AND AMENDING THE ZONING DISTRICTS MAP INCORPORATED BY REFERENCE IN CHAPTER 20, ARTICLE 5, SECTION 501, OF THE “CODE OF THE CITY OF LAWRENCE, KANSAS, 2003,” AND AMENDMENTS THERETO.
WHEREAS, after due and lawful notice and hearing, the Lawrence-Douglas County Metropolitan Planning Commission on May 26, 2004, recommended that the zoning classification for the tracts of land described in Section II of this ordinance all within the City of Lawrence, Douglas County, Kansas, be changed from A (Agricultural) District to RS-2 (Single-Family Residential) District.
WHEREAS, after due and lawful notice the zoning recommendation came on for hearing before the governing body of the City of Lawrence, Douglas County, Kansas on June 15, 2004, and after due consideration and deliberation the recommended zoning change was approved.
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:
SECTION I. The above stated recitals are by reference incorporated herein, and shall be as effective as if repeated verbatim.
SECTION II. That the zoning district classification for the following described tracts of land situated in the City of Lawrence, Douglas County, Kansas, to-wit:
TRACT A:
A TRACT OF LAND IN THE NORTHEAST QUARTER OF SECTION 32, TOWNSHIP 12 SOUTH, RANGE 19 EAST OF THE SIXTH PRINCIPAL MERIDIAN, DESCRIBED AS FOLLOWS:
BEGINNING AT A POINT ON THE EAST LINE, 50.00 FEET SOUTH OF THE NORTHEAST CORNER OF SAID QUARTER SECTION; THENCE SOUTH 01º57'13" EAST, ALONG SAID EAST LINE, 210.65 FEET; THENCE ON A 130.00 FOOT RADIUS CURVE TO THE LEFT, AN ARC DISTANCE OF 130.28 FEET, WITH A CHORD BEARING SOUTH 26º45'25" WEST, 124.90 FEET; THENCE SOUTH 01º57'13" EAST, 164.78 FEET; THENCE SOUTH 88º04'34" WEST, 239.39 FEET; THENCE NORTH 01º57’13” WEST, 485.00 FEET; THENCE NORTH 88º04'34" EAST, 299.39 FEET TO THE POINT OF BEGINNING.
SUBJECT TO ALL EASEMENTS, RIGHT-OF-WAYS, AND RESTRICTIONS OF RECORD.
TRACT B:
A TRACT OF LAND LYING IN THE NORTHEAST QUARTER OF SECTION 32, TOWNSHIP 12 SOUTH, RANGE 19 EAST OF THE SIXTH PRINCIPAL MERIDIAN, DESCRIBED AS FOLLOWS:
BEGINNING AT A POINT WHICH IS SOUTH 01º57'13" EAST, ALONG THE EAST LINE, 50.00 FEET AND SOUTH 88º04'34" WEST, 299.39 FEET FROM THE NORTHEAST CORNER OF SAID QUARTER SECTION; THENCE SOUTH 88º04'34" WEST, 179.63 FEET; THENCE SOUTH 01º57'13" EAST, 485.00 FEET; THENCE NORTH 88º04'34" EAST, 179.63 FEET; THENCE NORTH 01º57'13" WEST, 485.00 FEET TO THE POINT OF BEGINNING, ALL IN DOUGLAS COUNTY, KANSAS.
SUBJECT TO ALL EASEMENTS, RIGHT-OF-WAYS, AND RESTRICTIONS OF RECORD.
be and the same are hereby changed from that of A (Agricultural) District to RS-2 (Single-Family Residential) District as such district is defined and prescribed in Chapter 20 of the “Code of the City of Lawrence, Kansas, 2003,” and amendments thereto.
SECTION III. That the Zoning Districts Map incorporated by reference in and by Chapter 20, Article 5, Section 501, of the “Code of the City of Lawrence, Kansas, 2003,” be and the same is hereby amended by showing and reflecting thereon the new zoning district classification for the aforesaid tract, as set forth in Section II of this ordinance.
SECTION IV. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
