RESOLUTION NO. 6556

A RESOLUTION OF THE CITY OF LAWRENCE, KANSAS DECLARING AN UNMARKED, UNFENCED EXCAVATION WITHIN THE CITY OF LAWRENCE, KANSAS A NUISANCE; AND ORDERING THE ABATEMENT THEREOF; ALL PURSUANT TO K.S.A. 12-1617e, AND AMENDMENTS THERETO

BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

Section 1.  The unmarked, unfenced excavation located on the following described property:

NORTH LAWRENCE ADDITIONS NUMBERS 6 & 7 EAST 5 ACRES OF NORTH ½, ADDITION NUMBER 7, LESS 2.5 ACRES ALSO DESCRIBED AS BEGINNING AT A POINT 330 FEET NORTH OF THE SOUTHWEST CORNER OF THE SOUTHEAST ¼ OF THE NORTHEAST ¼ OF THE SOUTHWEST ¼ OF THE NORTHWEST ¼ SECTION 29, TOWNSHIP 12 SOUTH RANGE 20 EAST THENCE EAST 330 FEET THENCE NORTH 330 FEET THENCE WEST 330 FEET THENCE SOUTH 330 FEET TO POINT OF BEGINNING

is hereby declared a nuisance, is a menace and dangerous to the health of the inhabitants of the City, or the North Lawrence neighborhood of the City of Lawrence, Kansas.  The owner of the property shall remove and abate from the property the excavation within ten (10) days after publication of this resolution.  If the excavation is not filled by the property owner within the time set forth in this resolution, the City shall cause such the filling of the excavation to be done and shall assess the cost to the property owner.
