Member Bob Brookman called the meeting to order at 6:30 p.m.
1. Elect a Chair and Co-Chair
Member Jim Carpenter nominated Member Bob Brookman for Chairman, Member Frank
Lewis second the nomination, and the nomination passed 3-0. Member Frank Lewis
nominated Member Jim Carpenter for Co-Chairman, Member Bob Brookman second the
nomination, and the nomination passed 3-0.
2. Review
minutes from September 17, 2003.
Member Frank Lewis made a motion to approve the minutes from the April 21, 2004 meeting. Co-Chairman Jim Carpenter second the motion. The motion passed 3-0.
3. Discuss chapters 1 and 24 of the IRC (International Residential Code).
Before getting started with the review Chairman Bob Brookman asked if the guests were there for this subject and if they would like to speak now.
Mr. Allen Inlow introduced himself and stated as indicated from the Board’s minutes from last month he would get clarification on the direction of the City Commission to review the International Codes. Specifically the Boards right or ability to review or compare the Uniform Plumbing Code and Mr. Allen Inlow believed the memo from Mayor Mike Rundle would clarify the issue. Mr. Allen Inlow then handed out the memo to the board members. Mr. Allen Inlow requested that the board do a side by side comparison of the two codes, the 2003 Uniform Plumbing Code and the International Codes.
Chairman Bob Brookman stated that he thought it would be a more lengthy process to do a comparison and that he thought the City Commission had approved the International Codes for review. Chairman Bob Brookman went on to say that he thought the comparison of the two codes had taken place with the code committee.
Mr. Tim Pinnick stated that the City Commission approved the International Codes for review and that it was within the board’s authority to do a comparison.
Mr. Bryan Wyatt was recognized by Chairman Bob Brookman. Mr. Bryan Wyatt informed the board that he was on the Mechanical Board and he had received Mayor Mike Rundle’s memo at their meeting on Monday and that he also had a copy of the minute from the City Commission meeting in question. Mr. Bryan Wyatt then read excerpts from that meeting. Mr. Bryan Wyatt stated that he was on the code committee and they did a comparison of the two organizations, the NFPA (National Fire Protection Association Inc.) and the International Code Council. Mr. Bryan Wyatt went on to say that this was not a technical review, it was just a look at the two organizations.
Mr. Bryan Wyatt went on to say that if there was a question about a code interpretation, you could call IAPMO and with the International Codes you would have to go through the City to contact the ICC (International Code Council).
Chairman Bob Brookman brought the discussion back to the Board and stated that if the Commission wanted the Board to chose, he was more comfortable staying with the UPC (Uniform Plumbing Code).
Member Frank Lewis stated that there was still the Commission’s directive to review the International Code and asked if the Board should tell the Commission that they want to stick with the UPC.
Staff informed the Board that the Commission directed the trade boards to review the International Codes. Staff added that how the Board did its review, comparing the two codes or not was up to them.
Chairman Bob Brookman asked if the Board was reviewing the International Codes for adoption or reviewing it to review it.
Mr. Tim Pinnick answered that the intent is to review for adoption and like the Mayor’s memo stated if the Board wanted, do a comparison and recommend other wise.
Member Jim Carpenter stated that he thought the intent was to review the International Codes and in fairness the decent thing to do would be to look at both at the same time.
Chairman Bob Brookman asked if the Board was supposed to compare the two codes and make a recommendation on which one to go with.
Mr. Tim Pinnick responded that was a decision for the Board.
Chairman Bob Brookman made a motion to review both the International and the Uniform Plumbing Code and then make the recommendation base on which code better serves the City of Lawrence. Member Jim Carpenter second the motion, the motion passed 3-0.
Mr. Tim Pinnick stated that staff had two questions. 1. Had the Board read Mayor Mike Rundles memo and if there were any questions? All Board members read the memo and had no questions. 2. Had the Board seen the schedule for the review process and did they have any thoughts about it? Member Jim Carpenter stated as long as it took to review the 2000 UPC, the time table may be a little ambitious. Chairman Bob Brookman responded that the Board could just go with the schedule and if they ran out of time on any of them then they could just push it back.
Chairman Bob Brookman began the review by asking if there were any questions or concerns regarding Chapter 1 of the IRC (International Residential Code).
Staff conveyed to the Board that Section R112 Board of Appeals, as well as sections dealing with areas prone to flooding would likely be deleted. Staff went on to explain that the current ordinances address the trade boards and areas prone to flooding are addressed by the zoning ordinance.
Chairman Bob Brookman asked if anyone had other concerns.
Member Jim Carpenter expressed concern for sections R104.1 and R104.10 of the IRC. Staff pointed out that there was a similar section in the current code adopted by the City, to Member Jim Carpenter’s satisfaction.
With no further questions on Chapter 1, Chairman Bob Brookman
Member Jim Carpenter brought up section G2408.2 of the IRC and asked how this section would effect the installation of the new water heaters.
Staff replied that the new water heaters would not have to be elevated when installed in a garage according to section G2408.2.
Chairman Bob Brookman stated that while the Board is going through the IRC it should make a note of any sections that the Board may want to amend. Chairman Bob Brookman added that by doing that the Board would not have to go through the IRC again once they were done with the comparison.
Chairman Bob Brookman stated he had an issue with section G2420.5 of the IRC. Chairman Bob Brookman’s concern was that the IRC allowed a gas shut off to be six feet from an appliance apposed to three feet in the current code. Chairman Bob Brookman went on to say that there was no reason to make any motions now but to make note for later reference.
Chairman Bob Brookman stated his concern with section G2415.9 of the IRC Chairman Bob Brookman followed up that he agreed with the current codes requirement of a burial depth of eighteen inches rather than the twelve inch requirement of the IRC.
Member Jim Carpenter sited section G2417.4.1 of the IRC and stated that the “three times the working pressure” pressure test seemed confusing compared to the current code requirement of ten pound pressure test.
With no other comments, Chairman Bob Brookman moved on to the next agenda item.
4. Draft letter to City Commission regarding stubs on sewer mains.
The Board directed staff to draft the letter to the Commission regarding the
Board’s request to require stubs on sewer mains in new developments.
A motion was made by Member Frank Lewis to adjourn the meeting, Member Jim Carpenter second the motion, the motion passed 3-0. The chairman adjourned the meeting at 7:45 p.m.
