BEFORE THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS
IN THE MATTER OF THE VACATION OF THE PLATTED ACCESS RESTRICTIONS FOR THE COLLEGE MOTEL ADDITION, AND OF THE PLATTED ACCESS RESTRICTIONS FOR A LOT SPLIT FOR LOTS 2 AND 3, COLLEGE MOTEL ADDITION, VACATING THE RESTRICTION CONCERNING SHARED ACCESS FOR LOTS 1 AND 2, 2A (LOT SPLIT), AND ALLOWING A SIXTEEN (16') FOOT ACCESS FROM LOT 1 TO WEST 6TH STREET, UNTIL SUCH TIME LOT 1 IS REDEVELOPED ALL IN THE COLLEGE MOTEL ADDITION, A SUBDIVISION OF THE CITY OF LAWRENCE, KANSAS AND A LOT SPLIT FOR LOTS 2 AND 3, COLLEGE MOTEL ADDITION.
NOW on this 31st day of August, 2004 the above entitled matter comes for hearing before the Governing Body of the City of Lawrence, Kansas.
THEREUPON, the Governing Body examines the matter, hears comments on the petition and being duly advised in the premises finds as follows, to-wit:
1. The Governing Body has jurisdiction on the subject matter pursuant to K.S.A. 12-502 et seq. as amended.
2. That notice of hearing of said petition and the affidavit of publication thereof are examined and found to have been duly made in strict conformity with the laws of the State of Kansas.
3. That no private rights will be injured or endangered by such vacation.
4. That no objection to said petition has been filed with the City Clerk at the time of or prior to the hearing.
5. That the City Clerk shall certify a copy of this Order to the Register of Deeds of Douglas County, Kansas for recording as provided by K.S.A. 12-505, as amended.
IT IS THEREFORE, BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS, CONSIDERED AND ORDERED that the following described access restrictions with the Douglas County Register of Deeds, described as follows:
PLAT NOTE FROM THE PLAT OF THE COLLEGE MOTEL ADDITION AS DESCRIBED:
LOTS 1 AND 2 MUST SHARE ACCESS TO 6TH STREET AT THE LOCATION SHOWN HEREON.
AND THE RESTRICTION ON THE DEPICTION ON THE PLAT NOTING A 27.5 FOOT SHARED ACCESS FOR LOTS 1 & 2.
ALSO:
FROM A LOT SPLIT FOR LOTS 2 AND 3 COLLEGE MOTEL ADDITION, THE NOTE AS DESCRIBED BELOW:
LOT 2A MUST SHARE ACCESS TO 6TH STREET WITH LOT 1, COLLEGE MOTEL ADDITION AS SHOWN ON THE FINAL PLAT THEREOF.
AND THE RESTRICTION ON THE DEPICTION ON THE LOT SPLIT NOTING A 27.5 FOOT SHARED ACCESS FOR LOTS 1 & 2A.
Provided that the above vacation reserves a sixteen (16') foot access from Lot 1 to West 6th Street, until such time that Lot 1 is redeveloped. Upon redevelopment of Lot 1, all access to Lots 1 and 2A will be consolidated at the shared access location as originally shown on said plats. The access restriction are found on the Final Plat of College Motel Addition, recorded April 28, 2003 in Plat Book 17, page 549, with the Douglas County Register of Deeds, and in A Lot Split for Lots 2 and 3, College Motel Addition, recorded March 2, 2004 in Plat Book 17, Page 666 with the Douglas County Register of Deeds.
is hereby vacated.
