BEFORE THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS IN THE MATTER OF THE VACATION OF A UTILITY EASEMENT LOCATED ON THE NORTH SIDE OF LOT 1, SEDLOCK ADDITION, IN THE CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS.
NOW on this 31st day of August, 2004, the above entitled matter comes for hearing before the Governing Body of the City of Lawrence, Kansas.
THEREUPON, the Governing Body examines the matter, hears comments on the petition and being duly advised in the premises finds as follows, to-wit:
1. The Governing Body has jurisdiction on the subject matter pursuant to K.S.A. 12-502 et seq. as amended.
2. That notice of hearing of said petition and the affidavit of publication thereof are examined and found to have been duly made in strict conformity with the laws of the State of Kansas.
3. That no private rights will be injured or endangered by such vacation.
4. That no objection to said petition has been filed with the City Clerk at the time of or prior to the hearing.
5. That the City Clerk shall certify a copy of this Order to the Register of Deeds of Douglas County, Kansas, for recording as provided by K.S.A. 12-505, as amended.
IT IS THEREFORE, BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS, CONSIDERED AND ORDERED that the following described easement:
A 20’ UTILITY EASEMENT LOCATED ON THE NORTH SIDE OF LOT 1, SEDLOCK ADDITION, CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS, FILED WITH THE DOUGLAS COUNTY REGISTER OF DEEDS IN BOOK P17, PAGE 675, ON MARCH 22, 2004.
Is hereby vacated, provided that the Governing Body reserves a 10’ easement for utilities described as follows: a utility easement, 5’ on each side of the following described centerline; commencing at the northeast corner of Lot 1 of A Final Plat of Sedlock Addition a Replat of Lot 22 and Vacated 11th Street in Western Hills Suburban Rancheros a Subdivision in the City of Lawrence, Douglas County, Kansas; thence on an assumed bearing of south 88° 15’ 31” west on the north line of said Lot 1, a distance of 125.05 feet to the centerline of the existing 8” sanitary sewer line for a point of beginning; thence south 00° 22’ 58” east on the centerline of the existing 8” sanitary sewer line, a distance of 20.01 feet to the point of termination. The sidelines being prolonged or shortened to conform with the south line of the proposed vacated 20.00 utility easement at the north line of said Lot 1.
