ITEM NO. 4:        FINAL PLAT FOR GREEN TREE SUBDIVISION; NORTH OF HARVARD ROAD AND EAST OF GEORGE WILLIAMS WAY (SLD)

 

SUMMARY

 

PF-08-24-04:  Final Plat for Green Tree Subdivision.  This proposed 76 lot single-family residential subdivision contains approximately 26.7 acres and is located north of Harvard Road and east of George Williams Way.  Submitted by BG Consultants, Inc., for Fairway, L.C., property owner of record.

STAFF REVIEW

 

The subject property is located on the east side of George Williams Way and on the north side of Harvard Road. The property is also bounded by, but does not include, City future park property along the south/southeast property line and an exclusive gas line easement along the east/northeast property line. As a condition of approval of the Preliminary Plat for this property, a pedestrian connection from April Rain Road to the public park area was required. The Final Plat has been revised to show this connection. The pedestrian walkway is located in a combined utility and pedestrian easement midway between the intersection of Drum Drive and April Rain Court. This sidewalk will be constructed along with the other public improvements for the subdivision and shall be included on public improvement plans for the proposed subdivision. Additional connection to the public park will be provided at Harvard Road to the south and along the gas line easement abutting Lot 17, Block 4. Both of these access points are off-site and located outside of the boundary of the final plat.

 

The subject property was approved for single-family residential development earlier this year. The rezoning approval was subject to recording of a final plat prior to publication of the rezoning (Z-04-15-04). The Preliminary Plat was approved by the Planning Commission in July, 2004 (PP-06-14-04) subject to several conditions including the provision of a pedestrian easement from April Rain Road to the abutting park property along the southeast property line. Upon recording of the final plat the zoning district will be published. This will ensure that necessary easements and boundary lines coincide with the platted boundaries of the subject property.

 

Summary

The proposed plat complies with the minimum submission information required for Final Plats and complies with the pending zoning district for low-density residential development as well as the comprehensive plan related to low-density development, lot orientation, and access. 

 

Recommendation:  Staff recommends approval of the Final Plat and forwarding it to the City Commission for acceptance of easements and rights-of-way subject to the following conditions:  

1.      Execution of the following agreements:

     a. Agreement not to protest the formation of a benefit district for street, sidewalk and intersection improvements for both Harvard Road and George Williams Way

2.      Submission and approval of public improvement plans for all public improvements per approval of the Public Works Department;

3.      Pinning of the lots in accordance with Section 21-103 of the Subdivision Regulations.

4.      Execution of a Temporary Utility Agreement;

5.      Provision of the following fees and recording documentation:

a.      Copy of paid property tax receipt;

b.      Recording fees made payable to the Douglas County Register of Deeds;

c.      Provision of a master street tree plan.

d.      Provision of street sign fees.

6. Provision of a revised final plat to include the following note: “The City is hereby granted a temporary right of entry to plan the required street trees pursuant to Chapter 21, Article 7, Section 21-708a of the City Subdivision Regulations.”
