ITEM NO. 10C:         FINAL PLAT FOR HODGE SUBDIVISION; EAST SIDE OF FOLKS ROAD (EXTENDED) SOUTH OF W. SIXTH STREET (PGP)

 

PF-07-19-04:  Final Plat for Hodge Subdivision.  This proposed residential subdivision contains approximately 2.0635 acres and is located on the east side of Folks Road, south of W. Sixth Street.  Submitted by the Peridian Group, Inc., for Eric L. and Colleen M. Hodge, property owners of record.

 

GENERAL INFORMATION

 

Current Zoning and Land Use: A (Agricultural) District pending rezonings to RS-2 District [Z-06-22-04 & Z-07-30-04]; Existing house and outbuildings on northern parcel (proposed Tract “A”), vacant southern parcel (proposed Lot 1).

 

Surrounding Zoning and Land Use:

Ø      A (Agricultural) District to the north; Existing single-family house.

Ø      RS-2 to the east; Existing single-family homes.

Ø      RS-2 (Single-family Residential) District to the south; Existing single-family homes and approved but not recorded Pinnacle West No. 10, vacant single-family lots.

Ø      Pending PRD-2 (Planned Residential) District; Approved but not recorded, Oakley Court Planned Residential Development.

 

Reason for Request: To plat the property to allow for the building of a single-family house on Lot 1.

STAFF REVIEW

 

The final plat is located on the east side of the extension of Folks Road, south of W. 6th Street. The plat includes two parcels that are currently zoned A (Agricultural) with pending rezoning requests to RS-2 (Single-family Residential).

 

In March of 2004, the Subdivision Regulations were amended to require the platting of contiguous parcels under the same ownership. Staff requested the applicant include the applicant’s adjacent northern parcel in this plat.

 

The rezoning of the applicant’s northern parcel [Z-07-30-04] is scheduled for public hearing this month and was processed in conjunction with this preliminary plat. The rezoning of the applicant’s southern parcel [Z-06-22-04] was conditionally approved by the City Commission on August 23, 2004.

 

The applicant is proposing to plat the existing southern parcel as a lot to allow for the construction of a single-family house. The contiguous northern parcel has an existing house and outbuildings and is required to be included in this plat. Future additional single-family homes on the property would require a replat.

 

PUBLIC IMPROVEMENTS

 

Public improvement plans will be submitted to Public Works prior to the filing of the final plat at the Register of Deeds Office.

 

Note No. 11 on the preliminary plat stated, “Public improvement plans for the sanitary sewer main and storm sewer must be submitted to the City Public Works Department prior to filing of the Final Plat.”

 

Note No. 12 on the preliminary plat stated, “Infrastructure improvements (streets, storm sewer, water line, sanitary sewer) to be provided by private and benefit district financing.”

 

DEDICATION OF PUBLIC RIGHT-OF-WAY

 

The final plat dedicates the remainder portion of the eastern half of the right-of-way (40’ of the 80’ Collector) for Folks Road which is not acquired through the Benefit District.”

 

DEDICATION OF UTILITY EASEMENTS

 

The final plat dedicates a 10’ Utility Easement along the north and south side of the property boundary lines. A 25’ Utility Easement (10’ + 15’) exists on the adjacent property to the east.

 

CONCURRENT SUBMISSION

 

Per Section 21-204, the applicant is able to process a concurrent submission of a preliminary and final plat as:

 

  a. The plat does not create individual lots greater than 1 acre.

  b. The plat does not dedicate multiple street or road rights-of-way.

  c. The plat is not within more than one zoning category.

 

CONFORMANCE

 

There are a number of recommended conditions to the preliminary plat, primarily dealing with limiting direct vehicle access to the Folks Road collector. The final plat is a concurrent submission with the preliminary plat and would therefore need to have similar conditions. The final plat, with conditions, will conform to the proposed preliminary plat, with conditions. The submitted final plat conforms to the Zoning Ordinance and Subdivision Regulations.

RECOMMENDATION:      

 

Staff recommends approval of the Final Plat of Hodge Subdivision, and forwarding it to the City Commission for acceptance of easements and rights-of-way, subject to the following conditions:

 

1.      Provision of the following revisions to the final plat:

    1. Access to Folks Road from this property to be restricted to a 50’ wide x 40’ deep cross access easement which needs to be shown centered on the property lot line between Lots 1 and 2.
    2. Remove the 25’ wide by 40’ deep cross access easement shown on the north property line of Lot 2.
    3. The proposed 25’ Access Easement shown for Lot 1 be removed.
    4. The note, “Existing Drive to be relocated to north property line at the redevelopment of Lot 2 or the Mayhugh property whichever comes first”, be removed.”

2.      Provision of the following fees and recording documentation:

    1. Current copy of paid property tax receipt at the time of submittal of the final plat for filing.
    2. Recording fees made payable to the Douglas County Register of Deeds.
    3. Provision of a completed master street tree plan.
  1. Submittal of public improvement plans to the City Public Works Department (or letting of construction contracts for public improvements undertaken by benefit district) prior to filing of the final plat.
  2. Execution of a Temporary Utility Agreement.

 

Alternative: If the Planning Commission determines the plat as submitted, with proposed access for Lot 1 and the temporary/shared cross access easement for Lot 2 is acceptable, then the following conditions would be recommended:

1.      Provision of the following fees and recording documentation:

    1. Current copy of paid property tax receipt at the time of submittal of the final plat for filing.
    2. Recording fees made payable to the Douglas County Register of Deeds.
    3. Provision of a completed master street tree plan.
  1. Submittal of public improvement plans to the City Public Works Department (or letting of construction contracts for public improvements undertaken by benefit district) prior to filing of the final plat.
  2. Execution of a Temporary Utility Agreement.

 

It is relevant that this alternative approach was not recommended by staff because implementation lies beyond the current property owner’s ability to achieve.
