ITEM NO. 5:         FINAL PLAT FOR SEVENTH DAY ADVENTIST CHURCH; SOUTH OF W. 6TH STREET (HIGHWAY40) WEST OF E 1000 ROAD (QUEENS ROAD) (JLT)

 

PF-08-25-04:  Final Plat for Seventh Day Adventist Church. This proposed church site contains approximately 5.312 acres and is located south of W. 6th Street (Highway 40) and west of E 1000 Road (Queens Road).  Submitted by Landplan Engineering, P.A., for Kansas/Nebraska Association of Seventh Day Adventist Inc, property owner of record.

 

GENERAL INFORMATION

 

Current Zoning and Land Use:                   A (Agricultural) District (RS-2 pending), unplatted,

                                                          undeveloped.  

 

Surrounding Zoning and Land Use:             A (Agricultural) District to the north; unplatted, agricultural uses.

 

                                                          A (Agricultural) District to the east; unplatted, rural farm residence.

 

                                                          RS-2 (Residence Single-Family) District to the south; single-family homes and platted, undeveloped lots.

 

                                                          A (Agricultural) District to the west; unplatted, agricultural uses.

Easements dedicated:  As shown on final plat, including KDOT “public purpose” easement, extending 350’ south from W. 6th Street centerline.

 

Rights-of-Way:  75’ R/W along W. 6th Street; 70’ R/W south along Branchwood Drive adjacent to KDOT easement; and 60’ R/W further south to property line of subject parcel.

 

STAFF REVIEW

 

The subject property is located at the southwest corner of Queens Road/Branchwood Drive and W. 6th Street. The 4.07 acre lot is currently unplatted and undeveloped. Approval of this Final   Plat along with previously approved Preliminary Plat (PP-03-09-04) and Rezoning (Z-03-14-04) (both approved by the Planning Commission on May 26, 2004), are the preliminary development steps for a church use on the subject property, which is located at the fringe of City development along W. 6th Street. The property, along with a substantial area to the west was annexed into the City in 2001 as part of the Northwest Lawrence Annexation program to facilitate the W. 6th Street improvements now underway. The subject property and its immediate environs represent primarily agricultural lands transitioning to residential uses or to uses permitted within residential zoning districts, such as a church.

 

Access

 

A City ordinance restricts access within 350’ from centerline of W. 6th Street (U.S. Highway 40) on side roads, such as Queens Road/Branchwood Drive. Access restrictions along W. 6th Street were purchased by the State of Kansas as part of the overall road improvements program. Specific access to Queens Road/Branchwood Drive or Stonecreek Drive will be reviewed with the site plan submittal

 

Conformance with Horizon 2020

 

Horizon 2020 recognizes the subject property and its immediate area as representative of “Very Low Density Residential/Low Density Residential” uses, which corresponds with the single-family character of the approved RS-2 (Single-Family Residence) District zoning. 

 

STAFF RECOMMENDATION

Planning Staff recommends approval of PF-08-25-04, Final Plat for Seventh Day Adventist Church and forwarding it to the City Commission for acceptance of easements and rights-of-way, subject to the following conditions:

 

1.      Provision of the following fees and recording documentation:

    1. Current copy of paid property tax receipt at the time of submittal of the final plat for filing;
    2. Recording fees made payable to the Douglas County Register of Deeds.
    3. Submittal and approval of a Master Street Tree Plan.
  1. Execution of a Temporary Utility Agreement.
  2. Submittal of public improvement plans (water line, sanitary sewer, storm sewer and sidewalk) to Public Works Department prior to filing of the final plat.
  3. Execute an Agreement Not to Protest a Benefit District for street improvements on Queens Road/Branchwood Drive.
