RE:	Qdoba Sidewalk Dining License

KS-Mexican Grill, LLC, d/b/a Qdoba Mexican Grill, 947 Massachusetts, has applied for a sidewalk dining license.  Except for the fee, which we expect to receive prior to the October 5^th City Commission meeting, and subject to the approval of the related site plan (SP-08-57-04), the applicant has submitted all necessary requirements to obtain a sidewalk dining license. 

Earlier this year, KS-Mexican Grill LLC received a waiver (with restrictions) of the distance limitation that prohibits the sale or serving of alcoholic liquor within 400 feet from a school or church.  A copy of the waiver letter, approved by the City Commission on January 27, 2004, is attached.

KS-Mexican Grill LLC, has also received its City and State Drinking Establishment licenses.  The Commission approved the City license on August 24, 2004, subject to the 55% food sales requirement.
