RE:	Right-of-Way Acquisition – Folks Road Improvements

Pursuant to Resolution No. 6512 and Ordinance No. 7745 the City has established a special assessment benefit district to improve Folks Road south of West 6^th Street.  Pursuant to the benefit district, the City is acquiring the necessary right-of-way from adjoining property owners for this improvement.  The property interests  have been appraised and the review appraisal has confirmed the appraisal figures.

Staff offered the appraisal amount for the required takings owned by First Management, Inc. and Consolidated Properties of Lawrence, Inc.  The property owner has accepted the negotiated offer of $200,000 based upon the appraised value of the takings.  The property owner agreed to donate the necessary rights-of-way and easements for the construction of Old Oak Ct. and Larissa Drive.

Recommendation:

Staff recommends that the City purchase the necessary property interests from First Management, Inc. and Consolidated Properties of Lawrence, Inc. in the amount of $200,000.
