                                                ORDINANCE NO. 7832

 

AN ORDINANCE PROVIDING FOR THE REZONING OF APPROXIMATELY 20.0294 ACRES FROM A (AGRICULTURAL) DISTRICT TO PRD-2 (PLANNED RESIDENTIAL DEVELOPMENT) DISTRICT, AS HEREINAFTER SET FORTH, AND AMENDING THE ZONING DISTRICTS MAP INCORPORATED BY REFERENCE IN CHAPTER 20, ARTICLE 5, SECTION 501, OF THE “CODE OF THE CITY OF LAWRENCE, KANSAS, 2003,” AND AMENDMENTS THERETO.

 

WHEREAS, after due and lawful notice and hearing, the Lawrence-Douglas County Metropolitan Planning Commission on October 3, 2001, recommended with conditions that the zoning classification for the tract of land described in Section II of this ordinance all within the City of Lawrence, Douglas County, Kansas, be changed from A (Agricultural) District to PRD-2 (Planned Residential Development) District.

 

WHEREAS, after due and lawful notice the zoning recommendation came on for hearing before the governing body of the City of Lawrence, Douglas County, Kansas on October 23, 2001, and after due consideration and deliberation the recommended zoning change was approved, subject to conditions.

 

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

SECTION I.  The above stated recitals are by reference incorporated herein, and shall be as effective as if repeated verbatim.

 

SECTION II.  That the zoning district classification for the following described tract of land situated in the City of Lawrence, Douglas County, Kansas, to-wit:

 

LOT 1, BLOCK 3 AND LOT 2, BLOCK 2 TOGETHER WITH ADJACENT STREET RIGHT-OF-WAY IN WAKARUSA PLACE ADDITION, AN ADDITION IN THE CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS, DESCRIBED AS FOLLOWS:

 

BEGINNING AT THE NORTHWEST CORNER OF SAID LOT 1, THENCE NORTH 02°05’34” WEST A DISTANCE OF 40.00 FEET TO THE CENTER OF OVERLAND DRIVE; THENCE ALONG THE CENTER OF OVERLAND DRIVE ON THE FOLLOWING COURSES:  NORTH 88°11’21” EAST A DISTANCE OF 249.67 FEET; THENCE ALONG A CURVE TO THE RIGHT A DISTANCE OF 314.33 FEET, SAID CURVE HAS A RADIUS OF 600.00 FEET AND A CHORD BEARING SOUTH 76°48’09” EAST A DISTANCE OF 310.75 FEET; THENCE SOUTH 61°47’39” EAST A DISTANCE OF 24.08 FEET; THENCE ALONG A CURVE TO THE LEFT A DISTANCE OF 172.61 FEET, SAID CURVE HAS A RADIUS OF 600.00 FEET AND A CHORD BEARING SOUTH 70°02’08” EAST A DISTANCE OF 172.01 FEET TO THE CENTER OF CONGRESSIONAL DRIVE; THENCE CONTINUING ALONG THE CENTER OF OVERLAND DRIVE, ON A CURVE TO THE LEFT, A DISTANCE OF 141.55 FEET, SAID CURVE HAS A RADIUS OF 600.00 FEET AND A CHORD BEARING SOUTH 85°02’08” EAST A DISTANCE OF 141.23 FEET; THENCE NORTH 88°12’22” EAST A DISTANCE OF 266.11 FEET; THENCE ALONG A CURVE TO THE RIGHT A DISTANCE OF 305.18 FEET; SAID CURVE HAS A RADIUS OF 335.00 FEET AND A CHORD BEARING SOUTH 65°41’47” EAST A DISTANCE OF 294.73 FEET; THENCE SOUTH 39°35’55” EAST A DISTANCE OF 88.60 FEET; THENCE ALONG A CURVE TO THE LEFT A DISTANCE OF 76.03 FEET, SAID CURVE HAS A RADIUS 335.00 FEET AND A CHORD BEARING SOUTH 46°06’02” EAST A DISTANCE OF 75.87 FEET; THENCE SOUTH 37°23’52” WEST, A DISTANCE OF 40.00 FEET TO THE CORNER COMMON WITH LOTS 1 AND 2 IN SAID BLOCK 2; THENCE SOUTH 37°23’52” WEST, ALONG THE LINE COMMON WITH LOTS 1 AND 2 IN SAID BLOCK 2, A DISTANCE OF 67.59 FEET TO THE CORNER COMON WITH SAID LOTS 1, 2 AND LOT 3 IN SAID BLOCK 2; THENCE NORTH 54°17’02” WEST, ALONG THE SOUTHERLY LINE OF SAID LOT 2, A DISTANCE OF 53.29 FEET; THENCE SOUTH 88°12’22” WEST, ALONG THE SOUTH LINE OF SAID LOT 2, A DISTANCE OF 690.17 FEET TO THE CENTER OF CONGRESSIONAL DRIVE; THENCE SOUTH 01°55’21” EAST, ALONG THE CENTER OF CONGRESSIONAL DRIVE, A DISTANCE OF 500.11 FEET; THENCE SOUTH 88°12’22” WEST A DISTANCE OF 47.06 FEET TO THE SOUTHEAST CORNER OF LOT 1 IN SAID BLOCK 3; THENCE CONTINUE SOUTH 88°12’22” WEST, ALONG THE SOUTH LINE OF LOT 1 IN SAID BLOCK 3, A DISTANCE 657.32 FEET TO THE SOUTHWEST CORNER THEREOF; THENCE NORTH 02°05’34” WEST ALONG THE WEST LINE OF SAID LOT 1, A DISTANCE OF 937.75 FEET TO THE POINT OF BEGINNING.  CONTAINING 20.0294 ACRES MORE OR LESS.

be and the same are hereby changed from that of A (Agricultural) District to PRD-2 (Planned Residential Development) District as such district is defined and prescribed in Chapter 20 of the “Code of the City of Lawrence, Kansas, 2003,” and amendments thereto.

 

SECTION III.  That the Zoning Districts Map incorporated by reference in and by Chapter 20, Article 5, Section 501, of the “Code of the City of Lawrence, Kansas, 2003,” be and the same is hereby amended by showing and reflecting thereon the new zoning district classification for the aforesaid tract, as set forth in Section II of this ordinance.

 

SECTION IV.  This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
