STAFF RECOMMENDATION: Approval of the Final Plat of Apple Valley Subdivision, and forwarding it to the City Commission for acceptance of any easements and rights-of-way, subject to the following conditions: 1. Provision of the following revisions to the plat: a. Change the word “plan” to “plant” in general note no. 1. b. Change “Ninth Street” to “N. 9th Street ”. c. Provision of necessary perimeter utility easements. 2. Provision of the following fees and recording documentation: a. Current copy of paid property tax receipt. b. Recording fees made payable to the Douglas County Register of Deeds. c. Provision of a completed Master Street Tree Plan per Section 21-708a. 3. Provide an Agreement Not to Protest Formation of a Benefit District for street and sidewalk improvements to Elm Street and to N. 9th Street. 4. New driveway culvert pipes must be installed per the approval of the Department of Public Works. Submit a plan and profile of the existing and proposed roadside drainage system fronting the property. The profile must extend far enough along the right-of-way to identify optimum system grades. Identify all pipe sizes and flowlines for construction. This study must be approved by Public Works prior to release of building permits. 5. Execution of a Temporary Utility Agreement.

STAFF REVIEW
The final plat is located at 845 Elm Street in the North Lawrence Neighborhood. The final plat includes two lots and is within an RS-2 (Single-family Residential) zoning district.
The western lot (Lot 1) has an existing residence. The eastern lot (Lot 2) is vacant. The site is within a developed single-family residential neighborhood.
PUBLIC IMPROVEMENTS
An existing municipal water line and sanitary sewer line are located along Elm Street.
Elm Street and N. 9th Street are asphalt with drainage ditch sections and are not constructed to City standards. Elm Street has an existing 60’ right-of-way. There are no sidewalks along Elm Street. In lieu of street and sidewalk improvements at this time, Public Works is requesting an Agreement Not to Protest Formation of a benefit district for street and sidewalk improvements to Elm Street and to N. 9th Street.
The Stormwater Engineer has requested a condition for new driveway culvert pipes to be installed per the approval of Public Works, along with the submittal of a plan and profile of the existing and proposed roadside drainage system fronting the property.
FLOOD ZONE
The area is in the Federal Emergency Management Agency’s Flood Zone X – Shaded: This area protected from the one percent annual chance (100-year) flood by levee, dike or other structures subject to possible failure or overtopping during larger floods. The property is not considered to be within the Floodplain Overlay District.
PUBLIC RIGHT-OF-WAY
Elm Street has the required 60’ of public right-of-way for a local street. No additional dedication is warranted.
PERIMITER UTILITY EASEMENTS
Per Section 21-609, perimeter utility easements of 7.5’ on the rear lot line and 5’ on the side lot lines need to be provided.
CONFORMANCY
The setbacks for the existing house conforms with the required RS-2 zoning setbacks. The Apple Valley Subdivision No. 2 Final Plat, with conditions, would be in conformance with the Zoning and Subdivision Regulations.
