Easement Acquisition –Clinton Parkway Relief Sewer Improvements |
Legal Staff has been working to acquire the necessary property interests needed for this project (see Consent Agenda item 6 (a) above). In order to install the new relief sanitary sewer line (see attached map), an approximately 1,629 sq. ft. utility easement, together with a 2,418 sq. ft. temporary construction easement was needed on the Aberdeen Apartment complex property located at the southeast corner of Clinton Parkway and Wakarusa Drive. This project provides no direct benefits to the Aberdeen property. Legal and Utilities department staff have been working with the owners and their legal counsel to mitigate impact of the project on this property and to coordinate timing of the project. A negotiated settlement with the Aberdeen, LC group has been reached in lieu of obtaining these interests through eminent domain proceedings.
Recommendation:
Staff recommends that the City purchase the necessary property interests from Aberdeen, LC in the amount of $20,676. Funding will come from the Utilities Department Capital Improvement Project funds.
