ORDINANCE NO. 7777

 

AN ORDINANCE PROVIDING FOR THE REZONING OF APPROXIMATELY 32.253 ACRES FROM A (AGRICULTURAL) DISTRICT TO RS-2 (SINGLE-FAMILY RESIDENTIAL) DISTRICT, AS HEREINAFTER SET FORTH, AND AMENDING THE ZONING DISTRICTS MAP INCORPORATED BY REFERENCE IN CHAPTER 20, ARTICLE 5, SECTION 501, OF THE “CODE OF THE CITY OF LAWRENCE, KANSAS, 2003,” AND AMENDMENTS THERETO.

 

WHEREAS, after due and lawful notice and hearing, the Lawrence-Douglas County Metropolitan Planning Commission on October 23, 2002, recommended that the zoning classification for the tract of land described in Section II of this ordinance all within the City of Lawrence, Douglas County, Kansas, be changed from A (Agricultural) District to RS-2 (Single-Family Residential) District, subject to the following condition:

 

1)       Recording of a final plat prior to publication of the rezoning ordinance.

 

WHEREAS, after due and lawful notice the zoning recommendation came on for hearing before the governing body of the City of Lawrence, Douglas County, Kansas on May 4, 2004, and after due consideration and deliberation the recommended zoning change was approved, subject to the condition stated above.

 

WHEREAS, after due and lawful notice and hearing, the Lawrence-Douglas County Metropolitan Planning Commission on October 27, 2004, approved the Final Plat of Diamondhead Subdivision, subject to conditions.  Said zoning classification described in Section II of this ordinance is included in the final plat.  The governing body of the City of Lawrence, Douglas County, Kansas on November 9, 2004, accepted dedications and easements shown on said plat.  Upon completion of the recommended conditions, the final plat was recorded at the Douglas County Register of Deeds on November 29, 2004.

 

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

SECTION I.  The above stated recitals are by reference incorporated herein, and shall be as effective as if repeated verbatim.

 

SECTION II.  That the zoning district classification for the following described tract of land situated in the City of Lawrence, Douglas County, Kansas, to-wit:

 

A TRACT OF LAND IN THE NORTHWEST QUARTER OF SECTION 32, TOWNSHIP 12 SOUTH, RANGE 19 EAST OF THE SIXTH PRINCIPAL MERIDIAN, DESCRIBED AS FOLLOWS:

 

BEGINNING AT THE SOUTHEAST CORNER OF SAID QUARTER SECTION; THENCE SOUTH 87°56’28” WEST, ALONG THE SOUTH LINE OF SAID QUARTER SECTION, 1331.79 FEET TO THE SOUTHWEST CORNER OF THE SOUTHEAST QUARTER OF SAID QUARTER SECTION; THENCE NORTH 02°31’00” WEST, ALONG THE WEST LINE OF THE SOUTHEAST QUARTER OF SAID QUARTER SECTION, 1324.23 FEET TO THE NORTHWEST CORNER OF THE SOUTHEAST QUARTER OF SAID QUARTER SECTION; THENCE NORTH 88°00’33” EAST, ALONG THE NORTH LINE OF THE SOUTHEAST QUARTER OF SAID QUARTER SECTION, 340.90 FEET; THENCE NORTH 77°37’01” EAST, 53.72 FEET; THENCE NORTH 47°24’07” EAST, 132.83 FEET; THENCE SOUTH 42°35’53” EAST, 150.00 FEET; THENCE NORTH 47°24’07” EAST, 249.43 FEET; THENCE ON A 350.00 FOOT RADIUS CURVE TO THE LEFT, WITH A 23.27 FOOT CHORD BEARING NORTH 45°29’49” EAST, AN ARC DISTANCE OF 23.27 FEET; THENCE SOUTH 46°24’29” EAST, 30.00 FEET; THENCE SOUTH 58°43’28” EAST, 111.42 FEET; THENCE SOUTH 05°48’17” WEST, 240.56 FEET; THENCE SOUTH 05°35’04” EAST, 305.23 FEET; THENCE SOUTH 13°11’13” EAST, 97.40 FEET; THENCE SOUTH 25°28’07” EAST, 407.07 FEET; THENCE SOUTH 51°59’45” EAST, 115.10 FEET; THENCE SOUTH 73°46’45” EAST, 140.38 FEET; THENCE NORTH 87°40’23” EAST, 40.36 FEET TO THE EAST LINE OF SAID QUARTER SECTION; THENCE SOUTH 02°19’37” EAST, ALONG SAID EAST LINE, 270.90 FEET TO THE POINT OF BEGINNING. CONTAINS 32.253 ACRES, MORE OR LESS, ALL IN THE CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS.

 

be and the same is hereby changed from that of A (Agricultural) District to RS-2 (Single-Family Residential) District as such district is defined and prescribed in Chapter 20 of the “Code of the City of Lawrence, Kansas, 2003,” and amendments thereto.

 

SECTION III.  That the Zoning Districts Map incorporated by reference in and by Chapter 20, Article 5, Section 501, of the “Code of the City of Lawrence, Kansas, 2003,” be and the same is hereby amended by showing and reflecting thereon the new zoning district classification for the aforesaid tract, as set forth in Section II of this ordinance.

 

SECTION IV.  This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
