ORDINANCE NO. 7780
AN ORDINANCE PROVIDING FOR THE REZONING OF APPROXIMATELY 12.836 ACRES FROM A (AGRICULTURAL) DISTRICT TO RM-2 (MULTIPLE-FAMILY RESIDENCE) DISTRICT, AS HEREINAFTER SET FORTH, AND AMENDING THE ZONING DISTRICTS MAP INCORPORATED BY REFERENCE IN CHAPTER 20, ARTICLE 5, SECTION 501, OF THE CODE OF THE CITY OF LAWRENCE, KANSAS, 2003, AND AMENDMENTS THERETO.
WHEREAS, after due and lawful notice and hearing, the Lawrence-Douglas County Metropolitan Planning Commission on October 23, 2002, recommended that the zoning classification for the tract of land described in Section II of this ordinance all within the City of Lawrence, Douglas County, Kansas, be changed from A (Agricultural) District to RM-2 (Multiple-Family Residence) District, subject to the following condition:
1) Recording of a final plat prior to publication of the rezoning ordinance.
WHEREAS, after due and lawful notice the zoning recommendation came on for hearing before the governing body of the City of Lawrence, Douglas County, Kansas on May 4, 2004, and after due consideration and deliberation the recommended zoning change was approved, subject to the condition stated above.
WHEREAS, after due and lawful notice and hearing, the Lawrence-Douglas County Metropolitan Planning Commission on October 27, 2004, approved the Final Plat of Diamondhead Subdivision, subject to conditions. Said zoning classification described in Section II of this ordinance is included in the final plat. The governing body of the City of Lawrence, Douglas County, Kansas on November 9, 2004, accepted dedications and easements shown on said plat. Upon completion of the recommended conditions, the final plat was recorded at the Douglas County Register of Deeds on November 29, 2004.
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:
SECTION I. The above stated recitals are by reference incorporated herein, and shall be as effective as if repeated verbatim.
SECTION II. That the zoning district classification for the following described tract of land situated in the City of Lawrence, Douglas County, Kansas, to-wit:
A TRACT OF LAND IN THE NORTHWEST QUARTER OF SECTION 32, TOWNSHIP 12 SOUTH, RANGE 19 EAST OF THE SIXTH PRINCIPAL MERIDIAN, DESCRIBED AS FOLLOWS:
BEGINNING AT A POINT WHICH IS SOUTH 02°1937 EAST, 828.36 FEET ALONG THE EAST LINE, AND SOUTH 87°4023 WEST, 1127.71 FEET FROM THE NORTHEAST CORNER OF SAID QUARTER SECTION; THENCE SOUTH 01°5927 EAST, 487.65 FEET TO THE SOUTH LINE OF THE NORTHWEST QUARTER OF SAID QUARTER SECTION; THENCE SOUTH 88°0033 WEST, ALONG SAID SOUTH LINE, 1114.22 FEET TO THE EASTERN RIGHT-OF-WAY LINE OF THE SOUTH LAWRENCE TRAFFICWAY; THENCE NORTH 02°4221 WEST, ALONG SAID EASTERN LINE, 416.08 FEET; THENCE NORTH 14°5515 EAST, ALONG SAID EASTERN LINE, 262.32 FEET; THENCE SOUTH 69°3357 EAST, 718.10 FEET; THENCE NORTH 74°0040 EAST, 390.92 FEET TO THE POINT OF BEGINNING. CONTAINS 12.836 ACRES, MORE OR LESS, ALL IN THE CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS.
be and the same is hereby changed from that of A (Agricultural) District to RM-2 (Multiple-Family Residence) District as such district is defined and prescribed in Chapter 20 of the Code of the City of Lawrence, Kansas, 2003, and amendments thereto.
SECTION III. That the Zoning Districts Map incorporated by reference in and by Chapter 20, Article 5, Section 501, of the Code of the City of Lawrence, Kansas, 2003, be and the same is hereby amended by showing and reflecting thereon the new zoning district classification for the aforesaid tract, as set forth in Section II of this ordinance.
SECTION IV. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
