ORDINANCE NO. 7799
AN ORDINANCE PROVIDING FOR THE REZONING OF APPROXIMATELY 26.711 ACRES FROM A (AGRICULTURAL) DISTRICT TO RS-2 (SINGLE-FAMILY RESIDENTIAL) DISTRICT, AS HEREINAFTER SET FORTH, AND AMENDING THE ZONING DISTRICTS MAP INCORPORATED BY REFERENCE IN CHAPTER 20, ARTICLE 5, SECTION 501, OF THE “CODE OF THE CITY OF LAWRENCE, KANSAS, 2003,” AND AMENDMENTS THERETO.
WHEREAS, after due and lawful notice and hearing, the Lawrence-Douglas County Metropolitan Planning Commission on May 26, 2004, recommended that the zoning classification for the tract of land described in Section II of this ordinance all within the City of Lawrence, Douglas County, Kansas, be changed from A (Agricultural) District to RS-2 (Single-Family Residential) District.
WHEREAS, after due and lawful notice the zoning recommendation came on for hearing before the governing body of the City of Lawrence, Douglas County, Kansas on June 15, 2004, and after due consideration and deliberation the recommended zoning change was approved, subject to the condition of a final plat being approved and recorded with the Register of Deeds Office.
WHEREAS, a final plat of the subject tract of land was approved by the Planning Commission on September 22, 2004; accepted by the governing body of the City of Lawrence, Douglas County, Kansas on October 5, 2004, subject to conditions; and, the final plat was recorded with the Register of Deeds Office on November 16, 2004.
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:
SECTION I. The above stated recitals are by reference incorporated herein, and shall be as effective as if repeated verbatim.
SECTION II. That the zoning district classification for the following described tract of land situated in the City of Lawrence, Douglas County, Kansas, to-wit:
FINAL PLAT OF GREEN TREE SUBDIVISION; ALSO DESCRIBED AS:
A TRACT OF LAND LOCATED IN THE NORTHEAST QUARTER AND THE SOUTHEAST QUARTER OF SECTION 32, TOWNSHIP 12 SOUTH, RANGE 19 EAST OF THE SIXTH PRINCIPAL MERIDIAN IN THE CITY OF LAWRENCE, IN DOUGLAS COUNTY, KANSAS, DESCRIBED AS FOLLOWS:
BEGINNING AT THE NORTHWEST CORNER OF A TRACT CONVEYED TO FAIRWAY, L.C. RECORDED IN BOOK 913 ON PAGE 988 AT THE DOUGLAS COUNTY REGISTER OF DEEDS, SAID POINT OF BEGINNING BEING ON THE WEST LINE OF THE NORTHEAST QUARTER OF SAID SECTION 32, SOUTH 02º19'37" EAST (BEING THE BEARING SHOWN IN SAID FAIRWAY TRACT) 807.83 FEET (SAID FAIRWAY TRACT: 807.57 FEET) OF THE NORTH QUARTER CORNER OF SAID SECTION 32; THENCE ALONG THE WEST LINE OF THE NORTHEAST QUARTER OF SAID SECTION 32, SOUTH 02º19'37" EAST 1837.72 FEET (SAID FAIRWAY TRACT: 1837.67 FEET) TO THE CENTER CORNER OF SAID SECTION 32; THENCE NORTH 87º56'58" EAST, 315.33 FEET; THENCE ON A CURVE TO THE RIGHT WITH A RADIUS OF 600.00 FEET AN ARC LENGTH OF 66.86 FEET (FAIRWAY TRACT: 66.91 FEET), CHORD OF SAID CURVE BEARS: SOUTH 88º51'30" EAST, 66.82 FEET (SAID FAIRWAY TRACT: SOUTH 88º51'21" EAST, 66.88 FEET); THENCE NORTH 11º34'34" EAST, 544.83 FEET (SAID FAIRWAY TRACT: NORTH 11º34'09" EAST, 544.71 FEET); THENCE NORTH 56º56’28” EAST, 784.53 FEET (SAID FAIRWAY TRACT: NORTH 56º56’32” EAST, 784.65 FEET); THENCE NORTH 36º26’59” EAST, 60.67 FEET (SAID FAIRWAY TRACT: NORTH 36º23’46” EAST, 60.67 FEET); THENCE NORTH 57º04’08” WEST, 1500.55 FEET (SAID FAIRWAY TRACT: NORTH 57º04’13” WEST, 1500.56 FEET) TO THE POINT OF BEGINNING. THE ABOVE CONTAINS 26.711 ACRES, MORE OR LESS.
be and the same is hereby changed from that of A (Agricultural) District to RS-2 (Single-Family Residential) District as such district is defined and prescribed in Chapter 20 of the “Code of the City of Lawrence, Kansas, 2003,” and amendments thereto.
SECTION III. That the Zoning Districts Map incorporated by reference in and by Chapter 20, Article 5, Section 501, of the “Code of the City of Lawrence, Kansas, 2003,” be and the same is hereby amended by showing and reflecting thereon the new zoning district classification for the aforesaid tract, as set forth in Section II of this ordinance.
SECTION IV. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
