ORDINANCE NO.  7851

AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS, REPEALING CHAPTER XX OF THE "CODE OF THE CITY OF LAWRENCE, KANSAS, 2003 EDITION," AND AMENDMENTS THERETO, AND ENACTING A NEW DEVELOPMENT CODE FOR THE CITY OF LAWRENCE SETTING FORTH COMPREHENSIVE ZONING AND OTHER LAND USE REGULATIONS FOR THE CITY OF LAWRENCE PURSUANT TO KSA 12-741 ET SEQ., INCLUDING THE ADOPTION OF A NEW ZONING MAP FOR THE CORPORATE LIMITS OF THE CITY OF LAWRENCE, KANSAS.  

WHEREAS, after due and lawful notice and hearing, the Lawrence-Douglas County Metropolitan Planning Commission on November 17, 2004, recommended adoption of the “Development Code, November 17, 2004 Edition” (TA-10-05-04) with revisions and the “Zoning Map, November 17, 2004 Edition” (Z-10-49-04) with revisions to replace Chapter XX, “Zoning and Planning” of the Code of the City of Lawrence, Kansas, 2003 Edition, and amendments thereto, such documents establishing a new zoning ordinance and a new zoning map for the City of Lawrence pursuant to the provisions of K.S.A. 12-741 et seq. ; and

WHEREAS, the recommendations came before the governing body of the City of Lawrence, Douglas County, Kansas on December 14, 2004, and after due consideration and deliberation the recommended changes, with additional amendments, were approved and this ordinance was directed to be prepared;

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

SECTION I.  The above recitals are hereby incorporated by reference as if fully set forth herein.

SECTION II.  Chapter XX, of the Code of the City of Lawrence, Kansas, 2003 Edition, and amendments thereto is hereby repealed and is hereby replaced with the “Development Code, November 17, 2004 Edition”  (TA-10-05-04) with amendments recommended by the Planning Commission on November 17, 2004 and with amendments approved by the governing body on December 14, 2004.  The zoning map in Chapter XX of the Code of the City of Lawrence, Kansas, 2003 Edition is hereby repealed and is hereby replaced with the “Zoning Map, November 17, 2004, Edition” (Z-10-49-04) with amendments recommended by the Planning Commission on November 17, 2004 and as approved by the governing body on December 14, 2004.  The documents “Development Code, November 17, 2004 Edition” as amended, and “Zoning Map, November 17, 2004 Edition” as amended, are hereby incorporated by reference as fully set forth herein. Said documents, as amended, are on file in the Office of the City Clerk and in the Office of the Secretary of the Lawrence-Douglas County Metropolitan Planning Department. Provided, that the provisions in the Development Code establishing a “U” University District, including Section 20-218, shall not become effective until July 1, 2005.

SECTION III.  This ordinance shall take effect on, and be effective on and after, January 24, 2005.
