Jefferson’s Sidewalk Dining License

Fatlab, Inc., d/b/a Jefferson’s Restaurant, 743 Massachusetts, has recently applied for a sidewalk dining license. The related site plan (SP-05-28-04) for this outdoor seating area was approved by the City Commission on June 22, 2004. The delay in applying for the sidewalk dining license was apparently due to the applicant mistakenly believing that all requirements for a sidewalk dining area were satisfied with the approval of the site plan last June. This mistaken belief was due in part to staff’s release of the site plan even though the site plan condition requiring obtaining a sidewalk dining license had not been met.
Except for the sidewalk dining license fee, which we expect to receive prior to the March 15th City Commission meeting, the applicant has met all necessary requirements to obtain a sidewalk dining license (including demonstrating that it meets the 70% food sales requirement). In addition, the applicant requested that its patrons be allowed to possess and consume alcoholic beverages in the outdoor seating area. As such, enclosed is Ordinance 7867, which after its effective date, would allow possession and consumption of alcoholic beverages on this portion of city right of way.
Staff recommends approval of the sidewalk dining license for Jefferson’ s Restaurant and adoption of the related Ordinance 7867.
