TEMPORARY USE PERMITTED UPON REVIEW

TUPR-02-01-05:

A request for a Temporary Use Permitted upon Review for special events at Brandon Woods Retirement Community, 1501 Inverness Drive.  The events will be held indoors in various common areas within the Brandon Woods complex.  Submitted by Shannon Ruedlinger, Executive Director.

RM-1 (Multiple-Family Residence District); developed retirement community.

 

 

STAFF REVIEW

The request is for a Temporary Use Permitted Upon Review for special events in March, April and May at the Brandon Woods Retirement Community.  The events are a series of three day weekends:  March 17-19; March 25-27; April 24-26; and May 28-30.  City Commission approval is necessary in order to sanction the temporary liquor license application that is desired for these events.  State license approval is necessary to serve liquor at these events. 

 

Brandon Woods Club, Inc. (BWCI) was established as a means to provide Brandon Woods residents and guests alcoholic beverages during meals and special occasions.  Last fall, BWCI failed to renew a state license for a drinking establishment/private club and must now apply for a new license.  City staff has historically acknowledged a Use Permitted upon Review (UPR) for a Club or lodge, private as the means to issue a liquor license to uses located in residential zoning districts.  Brandon Woods is in the process of obtaining a UPR for the Brandon Woods Club; however final approval will not occur until mid-May.  The TUPR request has been submitted as a mechanism to facilitate special events planned this spring at the retirement community.  All events will be held indoors in the commons areas and no external impacts are anticipated.

 

TUPR Request

Per Section 20-1454.5 of the Zoning Ordinance, the request is classified as a Temporary Use, which does not meet the criteria for administrative approval.  The Brandon Woods site is residentially zoned which requires City Commission approval to permit the applicant to submit a request for a temporary liquor license to the Kansas Department of Revenue, Alcoholic Beverage Control Division.  In Staff's opinion, all conditions outlined in 20-1454.5 have been addressed.

 

Recommendation:  Planning Staff recommends approval of the request for a Temporary Use Permitted upon Review for special events at Brandon Woods Retirement Community on March 17-19; March 25-27; April 24-26; and May 28-30.
