A JOINT RESOLUTION OF THE CITY COMMISSION
OF THE CITY OF LAWRENCE, KANSAS (THE “CITY”) AND THE BOARD OF
COUNTY COMMISSIONERS OF DOUGLAS COUNTY, KANSAS (THE “COUNTY”) AMENDING THE QUALIFICATIONS FOR MEMBERS OF THE ECO2 COMMISSION
WHEREAS, by Joint Resolution the City (by City Resolution No. 6553) and the County (by County Resolution No. 04-22) (hereinafter the “Joint Resolution”) formally established the ECO2 Commission as a joint advisory commission to report to and advise both the City and the County on matters relating to the dual goals of (i) preservation, access, and management of open space, and (ii) acquisition of land, facilities and other supports to expand job opportunities in Douglas County, Kansas, including financing of both purposes.
WHEREAS, Section 5 of the Joint Resolution contains qualifications for membership on the ECO2 Commission, with one such qualification being residency in Douglas County, Kansas.
WHEREAS, the City and the County have determined it appropriate to also permit appointment to the ECO2 Commission of a person who has a regular place of employment in Douglas County, Kansas, even if not a resident of Douglas County, Kansas.
NOW, THEREFORE, be it jointly resolved by the governing body of the City of Lawrence, Kansas and the Board of County Commissioners of Douglas County, Kansas as follows:
1. Amendment to Section 5 of Joint Resolution. Section 5 of the Joint Resolution is hereby amended to read as follows:
Section 5. Number and Qualification of Members. The ECO2 Commission shall be comprised of eight members, each of whom shall reside within the geographic boundary of Douglas County, Kansas and none of whom shall hold either a salaried position or elective office with any City government in Douglas County or the County government; provided, however, that the initial appointments made to the ECO2 Commission in June of 2004 may include members who served on the ECO2 Initiative prior to adoption of the Joint Resolution that do not reside in Douglas County. Those members shall be exempt from the residency requirement until their initial term of appointment expires. Membership on the ECO2 Commission shall be voluntary and no member shall receive payment for service on the commission.
2. Remainder of Joint Resolution Reaffirmed. Except for amendments to Section 5 as set forth herein, the remainder of the Joint Resolution is not amended and is reaffirmed.
3. Effective Date. This Resolution shall only take effect and shall be in full force from and after its adoption by the last to adopt this Resolution of either the City or the County.
