BEFORE THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS IN THE MATTER OF THE VACATION OF A PORTION OF RIGHT-OF-WAY OF OREGON STREET, ADJACENT TO THE NORTHEAST CORNER OF BLK 5, EARL’S ADDITION, IN THE CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS
NOW on this 29TH day of March, 2005, the above entitled matter comes for hearing before the Governing Body of the City of Lawrence, Kansas.
THEREUPON, the Governing Body examines the matter, hears comments on the petition and being duly advised in the premises finds as follows, to-wit:
1. The Governing Body has jurisdiction on the subject matter pursuant to K.S.A. 12-502 et seq. as amended.
2. That notice of hearing of said petition and the affidavit of publication thereof are examined and found to have been duly made in strict conformity with the laws of the State of Kansas.
3. That no private rights will be injured or endangered by such vacation.
4. That no objection to said petition has been filed with the City Clerk at the time of or prior to the hearing.
5. That the City Clerk shall certify a copy of this Order to the Register of Deeds of Douglas County, Kansas, for recording as provided by K.S.A. 12-505, as amended.
IT IS THEREFORE, BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS, CONSIDERED AND ORDERED that the following described right-of-way:
A PORTION OF OREGON STREET, A STREET IN EARL’S ADDITION IN THE CITY OF LAWRENCE, DOUGLAS COUNTY, KASNAS, FILED WITH THE DOUGLAS COUNTY REGISTER OF DEEDS MARCH 16, 1867 IN BOOK A PAGE 13, DESCRIBED AS FOLLOWS:
Beginning at the Northeast corner of Block 5 of said Earl’s Addition; Thence East 60.00 feet to the Northwest corner of Block 6 of said Earl’s Addition; Thence South coincident with the West line of said Block 6, 300.89 feet to the Easterly prolongation of the North line of Lot 1 of Penny Addition; Thence West 60.00 feet to the Northeast corner of said Lot 1; Thence North coincident with the East line of said Block 5, 300.77 feet to the Point of Beginning. Containing 0.41 acres.
is hereby vacated provided that the Governing Body reserves a public easement over the east 50 ft. of the above described property for the construction, maintenance and use of all necessary facilities for utilities and public access, including but not limited to pedestrian and bicycle uses.
