ITEM NO. 9:           PRELIMINARY DEVELOPMENT PLAN FOR PHASE V, TARGET PCD OUTLOT; 221 W. 31ST STREET (SLD)

 

PDP-01-01-05:  Preliminary Development Plan request for Phase V, Target PCD Outlot.  This proposed planned commercial development is approximately 0.842 acre.  The proposed retail property is generally described as being located at 221 W. 31st Street, on the south side of 31st Street between Backyard Burger and Steak N Shake.  Submitted by Landplan Engineering, P.A., for Steak N Shake, 31st Commercial LLC, 31-98 Lawrence LLC, Goldberg Family Partnership LP, Dave & Susan Sidor, Dayton Hudson Corporation, Cottonwood, Inc., Marlin Revocable Trust c/o Payless ShoeSource Inc., and Vikar LLC, property owners of record.

 

STAFF PRESENTATION

Ms. Day introduced the item, a revised Preliminary Development Plan for the Target PCD, providing detail for development of an out lot that was added to the PCD as the surrounding areas developed.  She said the existing PCD, with its developed out lots, established an access easement along the south of the out lots. 

 

The added out lot was proposed as a 6000 sq. ft. building, possibly with multiple tenants and a range of uses.   A food service use was possible, but would not include a drive-through because this element was not shown on the proposed development plan.

 

An existing access easement provided a path through the development to the public right-of-way at Neider Road.  The only curb cut to 31st Street was a shared drive between Sonic & Backyard Burger.  The proposed revision also amended two other properties into the PCD.  Another revision to the overall preliminary development plan would be needed for redevelopment of those properties.

 

Ms. Day explained the existing phases were shown for reference.  No changes were being proposed to those portions of the development.  The applicant was asked to change the titles on the submitted plans to reflect that this was a revision to the overall PCD. The applicant was also asked to revise the plan to include a sidewalk from 31st Street along the western edge of the property.

 

Staff provided answers to several Study Session questions:

·         The original development plan had been approved for 221,860 gross sq. ft.

·         No limit was placed on the total amount of commercial square footage allowed for this development.

·         The subject area was considered part of the Regional Commercial Center described in HORIZON 2020 and limited to a total of 1.5 million square feet of commercial space, with no specifications for individual corners of the RCC.

·         The total amount of commercial square footage in the entire RCC was estimated at 1.3 million sq. ft. per 2003 revisions to HORIZON 2020. 

 

APPLICANT PRESENTATION

C.L. Maurer, Landplan Engineering, spoke on behalf of the applicant.  Mr. Maurer said the applicant had been working on the idea of providing additional pedestrian connections between the buildings along 31st Street.  The managers of those businesses appeared to support the concept, but an agreement had not yet been reached with the property owners.  Mr. Maurer said that, if an agreement could be reached, additional pedestrian connections would be shown on the Final Development Plan.  If not, the development would have the single pedestrian connection shown today.

There were no closing comments from the applicant or Staff.

The Commission had no additional questions or comments.

 

ACTION TAKEN

Motioned by Angino, seconded by Eichhorn to approve the revised Preliminary Development Plan for Phase V, Target PCD and forward it to the City Commission with a recommendation for approval, based on the findings of fact presented in the body of the Staff Report and subject to the following conditions:

 

1.                  Provision of a revised Preliminary Development Plan to show the location of the trash enclosure per staff approval; and

2.                  Provision of a revised Preliminary Development Plan to update the site summary information to include the Sidor and Cottonwood tracts amended into the development.

 

Motion carried unanimously, 10-0.
