Re:

Easement Acquisition (601 Indiana) – 6th & Indiana Sanitary Sewer Improvements City Project # CS04-04

Since December 2004, City legal staff has been acquiring right-of-entry agreements and temporary construction easements for the 6th & Indiana sanitary sewer system improvement project.  To date, a total of 14 instruments have been obtained from property owners impacted by the project.

The revised project plans identified one property, (601 Indiana – Rumsey-Yost Funeral Home), where a permanent sanitary sewer line easement (1,873 sq. feet) and a temporary construction easement (1,132 sq. feet) would be required in order to construct the improvements (see the attached map).

An appraisal of the property interests to be acquired was conducted by Aul & Hatfield Appraisals.  Staff offered the appraisal amount for the above easements and the property owner has accepted this offer ($18,730).

Recommendation:

Staff recommends that the City purchase the necessary property interests from Alfred and Fleda Yost in the amount of $18,730.  Funding will come from the Utilities Department capital improvement funds.
