PF-04-11-05: Final Plat for Marion Addition No. 5. This proposed one-lot commercial subdivision contains approximately 0.842 acres. The property is generally described as being located at 2221 W. 31st Street. Submitted by Landplan Engineering, PA, for G & P LC, property owner of record.
STAFF RECOMMENDATION: Staff recommends approval of the final plat of Marion Addition No. 5 and forwarding it to the City Commission with a recommendation for acceptance of easements based on the findings found in the body of the staff report and subject to the following conditions:
1) Execution of a Temporary Utility Agreement; 2) Execution of an agreement not to protest a benefit district for Street and Sidewalk improvements for 31st Street; (As previously recommended by the Planning Commission) 3) Provision of the following fees and recording documentation: a) Copy of paid property tax receipt; b) Recording fees made payable to the Douglas County Register of Deeds; and c) Provision of a master street tree plan. |

STAFF REVIEW
The subject property is part of the Target PCD- Phase V. A revised Preliminary Development Plan for the overall development has been previously approved by the Planning Commission. A parallel request for final development plan approval accompanies this request (Agenda Item 2B). The subject property is a single-lot plat. This parcel was added later into the Target development project and originally included a single-family home.
Development issues such as access and utility extension have been resolved through the review and approval processes. A cross access easement is established along the south property line providing access and connectivity to the overall development. Direct vehicular access to 31st Street is not proposed.
The final plat is in conformance with the requirements of the Zoning Ordinance and Subdivision Regulations. A previous recommendation included execution of an agreement not to protest the formation of a benefit district for street and sidewalk improvements for 31st Street. This recommendation is carried forward in this application for consistency. There are no immediate plans for improvements for this stretch of the street. The Final Plat has been revised to both show and note access restriction to 31st Street. Sanitary sewer is provided along the south side of the property. No public improvement plans are associated with this Final Plat. The lot corners are pinned.
Recommendation: Planning Staff recommends approval of the final plat of Marion Addition No. 5 and forwarding the final plat to the City Commission for acceptance of easements subject to the following conditions:
