ITEM NO 3: FINAL PLAT FOR HABITAT NEIGHBORHOOD ADDITION NO. 5; 800 BLOCK OF WALNUT STREET (PGP)
PF-04-13-05: Final Plat for Habitat Neighborhood Addition No. 5. This proposed 16-lot residential subdivision contains approximately 4.197 acres. The property is generally described as being located in the 800 block of Walnut Street. Submitted by Landplan Engineering, P.A., for Lawrence Habitat for Humanity, Inc., property owner of record.
STAFF RECOMMENDATION: Approval of the Final Plat of Habitat Neighborhood Addition No. 5 and forwarding it to the City Commission for acceptance of rights-of-ways and easements, subject to the following conditions: 1. Provision of the following fees and recording documentation: a. Current copy of paid property tax receipt at the time of submittal of the Final Plat for filing. b. Recording fees made payable to the Douglas County Register of Deeds. c. Provision of a completed Master Street Tree Plan per Section 21-708a. 2. Submission of Public Improvement Plans to Public Works prior to filing of the Final Plat. 3. Execution of a Temporary Utility Agreement. 4. Pinning of Lots in accordance with Section 21-302.2.

STAFF REVIEW
The Final Plat is located along the north and south sides of the 800 Block of Walnut Street in the North Lawrence Neighborhood. The property is vacant and is being developed for single-family residences within a RS-2 (Single-family Residential) Zoning District.
Platting of the property is required prior to the issuance of a building permit.
The Planning Commission approved the Preliminary Plat for this property [PP-01-04-05] on March 16, 2005, along with the following three variances:
I. Variance from Section 21-607.1(g), which required local streets intersecting opposite sides of another local or collector street to be offset 125 feet or more. Variance approved location of local street/cul-de-sac intersecting on the opposite sides of Walnut Street.
II. Variance from Section 20-608, which required a minimum of 100 feet lot depth in a RS-2 District. Variance approved 8 lots located on the north side of Walnut Street with depths of less than 100 feet.
III. Variance from Section 20-608, which required a minimum lot area of 7,000 square feet in a RS-2 District. Variance approved 2 lot areas of approximately 6,043 and 6,420 square feet.
Public Improvements and Access
Access to the lots will be from Comfort Court (a new cul-de-sac to be installed south of Walnut Street) and from Comfort Lane (a new street to be installed north of Walnut Street). Comfort Lane will end in a temporary turn-a-round.
Public sanitary sewer and water mains will be extended to the existing sanitary sewer and municipal water mains located in Walnut Street.
An agreement not to protest the formation of a Benefit District for Street and for Sidewalk improvements to Walnut Street has been signed by the property owner.
An acceptable grading plan has been submitted to the approval of the City Stormwater Engineer, as required per condition of the Preliminary Plat.
TRACT ‘A’
The following note is shown on the Final Plat, “Tract ‘A’ is reserved for future development and will be maintained by the owner.”
CONFORMANCE
The Final Plat conforms to the approved Preliminary Plat.
