RE:	Free State Brewing Company Sidewalk Dining License

Free State Brewing Company, 636 Massachusetts, has applied for a sidewalk dining license and has provided all necessary documents for that license.  Specifically, we have received the annual fee payment ($360.50), written permission from the owner; proof of insurance; food sales reports; and the right of way agreement.  The related site plan (N-04-03-05/SP-02-19-05) was approved by the City Commission on June 7, 2005.

In addition, the applicant requested that its patrons be allowed to possess and consume alcoholic beverages in the outdoor seating area.  As such, enclosed is Ordinance 7874, which after its effective date, would allow possession and consumption of alcoholic beverages on this portion of city right of way. 

Staff recommends approval of the sidewalk dining license for Free State Brewing Company and adoption of the related Ordinance 7874.
