ITEM NO 2A:            FINAL PLAT FOR AUTO EXCHANGE; 3301 SOUTH IOWA STREET (PGP)

 

PF-05-15-05:  Final Plat for Auto Exchange Auto Dealership (Dunigan Subdivision 2nd Plat).  This proposed one-lot commercial subdivision contains approximately 0.5 acres.  The property is generally described as being located at 3301 South Iowa Street.  Submitted by Paul Werner Architects, L.L.C., for Auto Exchange, Inc., property owner of record.

 

 

STAFF RECOMMENDATION: Approval of the Final Plat of Dunigan Subdivision 2nd Plat, and forwarding it to the City Commission for acceptance of right-of-way and easements, subject to the following conditions:

1.      Provision of the following fees and recording documentation:

a.      Current copy of paid property tax receipt at the time of submittal of the Final Plat for filing.

b.      Recording fees made payable to the Douglas County Register of Deeds.

c.      Provision of a completed Master Street Tree Plan per Section 21-708a.

2.      Submission of Public Improvement Plans to Public Works prior to filing of the Final Plat.

3.      Execution of a Temporary Utility Agreement.

4.      Pinning of Lot in accordance with Section 21-302.2.

5.      Reflect the new Planning Commission Chairperson’s name on the plat (Chairperson to be selected at June Planning Commission meeting.)

 

 

Applicant’s Reason for Request:

 

Platting of property required for building permit/development of property.

 

KEY POINTS

 

·        The Final Plat is being considered in conjunction with a Final Development Plan for the property [FDP-05-05-05].

·        The location of the access for the property has been a concern from the beginning of this project.

·        There is an existing access to the property from 33rd Street.

·        A property is not allowed to be platted without access (lot can not be landlocked).

·        Wording for the potential internal cross access easements indicated on the adjacent Final Development Plan and adjacent Final Plat, have not been perfected.

·        Modified conditions of the Preliminary Development Plan/Preliminary Plat were approved by the City Commission.

GENERAL INFORMATION

 

Current Zoning and Land Use:

PCD-2 (Planned Commercial Development) District, Existing retail business building (Wright’s Wallcovering) building to be demolished.

 

Surrounding Zoning and Land Use:

PCD-2 (Planned Commercial Development) District to south and west; Pizzeria Uno Chicago Bar and Grill Restaurant & Parking Lot, Culvers Restaurant/drive-thru and J. C. Penny.

 

C-5 (Limited Commercial) District to the east; Iowa Street, across Wal-Mart.

 

PCD-2 (Planned Commercial Development) District to the north; 33rd Street, across McDonalds Restaurant and Target.

STAFF REVIEW

 

This, the first plat of the property, provides for an additional 10’ of public right-of-way for Iowa Street (U.S. Highway 59).

 

The Final Plat is located at the southwest corner of 33rd and Iowa Streets. The property has an existing retail building, which is vacant and is proposed to be torn down, to make way for an auto dealership. The property is zoned PCD-2 (Planned Commercial Development) District. A Final Development Plan [FDP-05-05-05] has been submitted in conjunction with this application.

Public Improvements and Access

 

Access to the lot will be from 33rd Street. Public improvement plans should include improvements to the access and sidewalks along 33rd Street and Iowa Street.

 

An Agreement Not to Protest the Formation of a Benefit District for future improvements at:

  1. The intersection of 33rd Street and Nieder Road;
  2. The intersection of 33rd & Iowa Street; and
  3. Between the two intersection of Nieder Road and Iowa on 33rd Streets;

were requirements of the Preliminary Development Plan/Preliminary Plat.  The signed Agreement Not to Protest the Formation of a Benefit District, was submitted to planning.

 

CONFORMANCE

 

The Final Plat conforms to the approved Preliminary Plat which was reviewed as part of the Preliminary Development Plan.
