RE:	Encroachment Agreement -  Partners in Grace  133 Perry

Staff has reviewed a request from Partners in Grace, Inc., owners of a mobile home park at 133 Perry, for the execution of an encroachment agreement.  Certain mobile homes encroach upon un-built portions of City right-of-way and moving the mobile homes will be costly and possibly detrimental to the integrity of the homes.   The City does not desire to vacate the existing right-of-way along Perry and Lincoln Streets, however, City staff can recommend the attached encroachment agreement.  The agreement allows for the mobile homes to continue to encroach upon City right-of-way until the City needs the right-of-way for public purposes. Fire, Utilities, Public Works have reviewed the situation and concur in proceeding with the agreement.

Recommended action:   Authorize City Manager to execute encroachment agreement with Partners in Grace, Inc., if appropriate.
