RE:	July 26, 2005 Agenda Item Public Hearing – Vacation of Utility Easement – Stonegate IV Addition

Please include the following item on the City Commission regular agenda for consideration at the July 26, 2005 meeting:

The City Commission will hold a public hearing for the vacation of a utility easement between Lots 4 and 5, Block 3, Stonegate IV Addition.  The Stonegate IV Addition is located north of Peterson Road and on the east side of Monterey Way.  This easement was dedicated on the plat as a utility easement.  In retrospect, it should have been a drainage easement; it will be dedicated by separate instrument.  No development or improvements have begun and, therefore, all utility companies are satisfied with this request.  Staff recommends approval of the vacation of this utility easement.

Action Requested:  Hold public hearing and, pending public discussion, approve Order of Vacation.
