ITEM NO 1:               FINAL PLAT FOR FAMILY VIDEO MOVIE CLUB ADDITION;      1818            MASSACHUSETTS (LAP)

 

PF-06-22-05:  Final Plat for Family Video Movie Club Addition, a Replat of  Lots 11 & 12 and the north 50 feet of Lot 22 & all of Lots 23 & 24, Block 16, Babcock’s Enlarged Addition.  The property is generally described as being located at 1818 Massachusetts. This proposed one-lot commercial subdivision contains approximately 1.004 acres. Submitted by Landplan Engineering, P.A., for Family Video, contract purchaser, and First National Bank of Lawrence, property owner of record.

 

STAFF RECOMMENDATION:  Approval of the Final Plat for Family Video Movie Club Addition and forwarding it to the City Commission for acceptance of easements, subject to the following conditions:

1.      Provision of the following fees and recording documentation:

a)     A current copy of a paid property tax receipt.

b)     Recording fees made payable to the Douglas County Register of Deeds.

c)      A completed Master Street Tree Plan in accordance with Section 21-708a.3.

d)     Filed copies of the cross access and utility easements.

2.      A Temporary Utility Agreement.

3.      Revision of the final plat to include the following:

a)     Reference of Book and Page numbers for the cross access and utility easements.

 

Applicant’s Reason for Request:

To formalize the combination of Lots 11, 12, the north 50 feet of Lot 22, Lots 23 and 24. New cross access and utility easements will be dedicated by separate instrument and reflected on the plat.

 

KEY POINTS

·         The legal description for the subject property includes portions of platted lots. GENERAL INFORMATION

 

Current Zoning and Land Use:

C-5 (Limited Commercial) District; Salvation Army thrift store.

RS-2 (Single-family Residential) District to the east; single-family residences.

STAFF REVIEW

 

The applicant is requesting final plat approval of the Family Video Movie Club Addition, which is a one lot commercial subdivision. The site is located east of Massachusetts Street, west of New Hampshire Street, and south of the Dillon’s grocery store.

 

The subject property was originally platted as part of Babcock’s Enlarged Addition in 1865. As the pending redevelopment of the site is considered to be a significant alteration to existing development, a replat is required. The legal description for the property includes portions of previously platted lots. The replat will formalize the previous combination of Lots 11, 12, the north 50 feet of Lot 22, Lots 23 and 24. Additionally, new cross access and utility easements will be dedicated by separate instrument and reflected on the plat.

 

Access

Access to the property will be provided by 25-foot wide drives along the eastern, western, and northwestern edges of the site. One Massachusetts Street curb cut is being eliminated with this project. In order to formalize the flow of vehicles from the subject site to the access point that is located on the adjacent property to the north and vice versa, a cross access easement will be dedicated by separate easement and depicted on the plat. This cross access easement will extend north-south through the parking lot at the western portion of the site, and will include two Massachusetts Street access points – one of which is located on the subject property, and one of which is located on the property to the north. When the adjacent properties to the north and south redevelop, additional cross access easements will be requested.

Public Improvements

As a sanitary sewer main is located underneath the existing building, the main will be relocated in front of the proposed building. The new utility easement will be 7.5 feet wide at the southernmost portion of the lot and will increase in size to a 15-foot easement as it extends north through the site. This easement will be dedicated by separate instrument and depicted on the plat. Because submittal of public improvement plans was a condition of approval for the Family Video site plan, public improvement plans have been submitted for the sewer main and are being reviewed by the Public Works staff.

 

Public improvement plans are also being reviewed for the reconstruction of a six-foot sidewalk along the eastern side of Massachusetts Street; the construction of a five-foot sidewalk along the western side of New Hampshire Street; and reconstruction of curb and gutter to close the existing northern curb cut on Massachusetts Street.

 

Existing water mains are located within the Massachusetts Street right-of-way in front of the subject property, and within the New Hampshire Street right-of-way along the rear of the subject property.

 

As the impervious surface area of the site is decreasing from 41,702 square feet to 37,931 square feet, no new detention is required with the redevelopment of the site.

 

Summary

In accordance with Section 21-302.2, the proposed lot has been pinned. The replat conforms with the Zoning Ordinance and Subdivision Regulations.
