RE:

October 11 , 2005 Agenda Item

Public Hearing – Vacation of Right-Of-Way

At its meeting on October 11, 2005 the City Commission needs to hold a public hearing on the petition of Kevin and Christy Kennedy, 1601 Kentucky Street, and Tom Hoffman and Lee Blackledge, 1538 Tennessee Street, requesting the vacation of the south 20 ft. of right-of-way on 16th Street between Kentucky and Tennessee.  The applicants would like to relocate the sidewalk closer to the street.  The sidewalk is brick and would be reconstructed.  The right-of-way of 16th Street is 100 ft.

SBC does have a cable within the existing right-of-way but does not object to the vacation if an easement is retained.  A sanitary sewer main also runs north/south along the rear of the properties.

Action Requested:  Open public hearing and pending discussion approve vacation retaining an easement for utilities.

Respectfully submitted,
