RE:

October 11 , 2005 Agenda Item

Public Hearing – Vacation of Right-Of-Way

The city will hold a public hearing at its meeting on October 11, 2005 to hear the petition of Bryan Sorenson, 1516 E. 25th Terrace, and Clyde Mosher, 1600 E. 25th Terrace, on the request to vacate the right-of-way of Rawhide Lane north of 25th Terrace.

This platted right-of-way exists between the properties owned by Mr. Sorenson and Mr. Mosher.  The area is currently being used for access and parking.  The street cannot extend north due to existing structures.  Mr. Sorenson would also like to add onto his home.

A waterline exists within the right-of-way but is a dead end,  and the utility department is wanting to remove this section of main at some point.  They have agreed to work with Mr. Sorenson and remove the line when he is ready to proceed with the addition.

A utility easement at the north end of the right-of-way is needed for a sanitary sewer main.

Action Requested:  Hold public hearing and pending discussion approve vacation with conditions.

Respectfully submitted,

Charles F. Soules, P.E.
