ORDINANCE NO.  7942

 

AN ORDINANCE REPEALING ORDINANCE NO. 7883, AND EXTENDING THE TEMPORARY MORATORIUM FOR THE ISSUANCE OF BUILDING PERMITS FOR CERTAIN PROPERTIES UNTIL FEBRUARY 1, 2006.

 

Whereas,  The Governing Body of the City of Lawrence, Kansas adopted Ordinance 7883 on June 7, 2005 establishing a temporary building permit moratorium area for areas identified in the Hillcrest, Old West Lawrence and Pinckney (HOP) District Plan where further study was needed regarding zoning designations, and;

 

Whereas,  Ordinance 7883 expires on December 10, 2005, and;

 

Whereas,  The Governing Body on October 25, 2005, initiated consideration of certain rezonings in the HOP moratorium area and desires to extend the building permit moratorium area for those properties whose rezonings were initiated on October 25, 2005, until February 1, 2006.

 

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

Section 1.     The temporary building permit moratorium for the issuance of building permits within the temporary moratorium area, as defined and set forth in Exhibit A attached hereto, shall be in effect until February 1, 2006.  Said Exhibit A is hereby incorporated as if fully set forth herein.  No building permit shall be issued in the Temporary Moratorium Area until February 1, 2006, or the repeal, or amendment of this ordinance.

 

Section 2.  Ordinance No. 7883 is hereby repealed.

 

Section 3.    This ordinance shall take effect and be in force from and after its adoption and publication as provided by law.
