ITEM NO 6:               FINAL PLAT FOR HEDGES SUBDIVISION; LOTS 16, 17, AND PART OF 18, BLOCK EIGHT, UNIVERSITY PLACE (LAP)

 

PF-09-33-05:  Final Plat for Hedges Subdivision, a Replat of Lots 16, 17, and part of 18, Block Eight, University Place. This proposed one-lot residential subdivision contains approximately 0.319 acre. The property is generally described as being located on Illinois Street south of 17th Street. Submitted by Peridian Group, Inc., for Blake A. and Kristin V. Hedges, property owners of record.

 

Item 6 was pulled from the Consent Agenda.

 

STAFF PRESENTATION

Ms. Pool introduced this item and indicated a replat was required because of the intent to build a detached garage on the separate vacant lot (Lot 16). The block has a similar ownership pattern, with lots having split ownership. Each individual owner would need to make requests for replat as needed. Staff recommended approval with conditions.

APPLICANT PRESENTATION

There was no applicant present for comment.

COMMISSION DISCUSSION

Burress questioned the status of the remainder portion of Lot 18.  Staff indicated that part of the lot was not under the applicant’s ownership and was part of the neighbor’s property.  He was concerned that the commission’s action would result in conflicting legal descriptions for property that is part of the original Lot 18.  Staff indicated that the current descriptions include the separate parts of the lot and that this is common throughout the older parts of the City.

 

Burress questioned if the new policies will address issues such as this. Staff responded new subdivision policies will require the replatting of whole lots. Lawson raised the question how would the replat work. Staff reiterated that whole lots will need to be replatted and that owners will need work with each other. Burress requested information on the additional cost of including all of Lot 18 in the replat. Staff responded that additional surveying costs would be minimal however; the multiple ownership of the lot could be an issue.

 

COMMISSION DISCUSSION

ACTION TAKEN

Motioned by Lawson, seconded by Harris to approve the Final Plat for Hedges Addition and forward it to the City Commission for acceptance of easements and rights-of-way, subject to the following conditions:

1.      Provision of the following fees and recording documentation:

a.      A current copy of a paid property tax receipt.

b.      Recording fees made payable to the Douglas County Register of Deeds.

c.      A completed Master Street Tree Plan in accordance with Section 21-708a.3.

2.   Execution of a Temporary Utility Agreement.

 

          Motion carried unanimously, 9-0.
