ITEM NO. 6:              FINAL PLAT FOR HEDGES SUBDIVISION; LOTS 16, 17, AND PART OF 18, BLOCK EIGHT, UNIVERSITY PLACE (LAP)

 

PF-09-33-05:  Final Plat for Hedges Subdivision, a Replat of Lots 16, 17, and part of 18, Block Eight, University Place. This proposed one-lot residential subdivision contains approximately 0.319 acre. The property is generally described as being located on Illinois Street south of 17th Street. Submitted by Peridian Group, Inc., for Blake A. and Kristin V. Hedges, property owners of record.

 

STAFF RECOMMENDATION:  Approval of the Final Plat for Hedges Subdivision and forwarding it to the City Commission for acceptance of easements and rights-of-way, subject to the following conditions:

1.      Provision of the following fees and recording documentation:

a)     A current copy of a paid property tax receipt.

b)     Recording fees made payable to the Douglas County Register of Deeds.

c)      A completed Master Street Tree Plan in accordance with Section 21-708a.3.

2.      A Temporary Utility Agreement.

 

Applicant’s Reason for Request:

To formalize the combination of Lots, 16, 17, and part of 18, Block Eight, University Place.

 

KEY POINTS

·         The applicant has indicated intent to build a detached garage to serve the existing residence. Because accessory structures must be accessory to the main structure, the lots must be combined prior to constructing the garage.

STAFF REVIEW

The applicant is requesting final plat approval of the Hedges Subdivision, which is a one lot residential subdivision. The site is located east of Illinois Street, west of Mississippi Street, and south of 17th Street.

 

The subject property was originally platted as part of University Place in 1887. The applicant has indicated intent to build a detached garage to serve the existing residence. A replat is required prior to constructing the garage, as the detached garage and main residence must be located on the same lot. The legal description for the property includes portions of previously platted lots. The replat will formalize the previous combination of Lots 16, 17, and the south five feet of Lot 18.

 

Street Rights-of-Way

No new rights-of-way have been dedicated with this project, as the current 60-foot right-of-way dedication along Illinois Street is sufficient to serve the new lot.

 

Water/Sanitary Sewer Services

Existing water mains are located within the Illinois Street right-of-way in front of the subject property. Sanitary sewer mains are located behind the subject property, within the alley right-of-way.

 

Conformance

The replat meets the minimum lot size (7,000 square feet), width (60 feet), and depth (100 feet) for the RS-2 (Single-family Residential) District. The new lot will comprise a width of 105 feet, a depth of 132 feet, and a lot area of 13,891 square feet.

 

Regarding setback requirements for the RS-2 (Single-family Residential) District, the existing house meets the minimum five-foot side yard setback and minimum 30-foot rear yard setback requirements. The existing garage is in compliance with the setback requirements for accessory structures taking access from an alleyway. However, the existing porch extends into the minimum 25-foot front yard setback. Because this non-complying structure is not being expanded, no variances are required from the Board of Zoning Appeals at this time.

 

Summary

In accordance with Section 21-302.2, the proposed lot has been pinned. The replat conforms with the Zoning Ordinance and Subdivision Regulations.
