ORDINANCE NO. 7943

 

AN ORDINANCE PROVIDING FOR THE REZONING OF 10.281 ACRES FROM A (AGRICULTURAL) DISTRICT TO RS-2 (SINGLE-FAMILY RESIDENCE) DISTRICT, AS HEREINAFTER SET FORTH, AND AMENDING THE ZONING DISTRICTS MAP INCORPORATED BY REFERENCE IN CHAPTER 20, ARTICLE 5, SECTION 501, OF THE “CODE OF THE CITY OF LAWRENCE, KANSAS, 2003,” AND AMENDMENTS THERETO.

 

WHEREAS, after due and lawful notice and hearing, the Lawrence-Douglas County Metropolitan Planning Commission on September 28, 2005, recommended that the zoning classification for the tract of land described in Section II of this ordinance all within the City of Lawrence, Douglas County, Kansas, be changed from A (Agricultural) District to RS-2 (Single-Family Residence) District.

 

WHEREAS, the zoning recommendation came before the governing body of the City of Lawrence, Kansas on November 1, 2005, and after due consideration and deliberation the recommended zoning change was authorized.

 

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

SECTION I.  The above stated recitals are by reference incorporated herein, and shall be as effective as if repeated verbatim.

 

SECTION II.  That the zoning district classification for the following described tract of land situated in the City of Lawrence, Douglas County, Kansas, to-wit:

                                                 

A TRACT OF LAND IN THE SOUTHWEST QUARTER OF SECTION 27, TOWNSHIP 12 SOUTH, RANGE 19 EAST OF THE SIXTH PRINCIPAL MERIDIAN, IN THE CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS, DESCRIBED AS FOLLOWS:

 

BEGINNING AT A POINT ON THE EAST LINE, 1065.14 FEET NORTH OF THE SOUTHEAST CORNER OF SAID QUARTER SECTION; THENCE NORTH 89°49’31” WEST, ALONG THE NORTH LINE OF LOTS 91 THROUGH 107 AND THEIR EASTERN EXTENSION IN MONTEREY SUBDIVISION NO. 1, A SUBDIVISION IN THE CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS, 1376.96 FEET TO THE NORTHWEST CORNER OF SAID LOT 91; THENCE NORTH 00°00’19” EAST, ALONG THE EAST LINE OF LOTS 82 THROUGH 89 IN SAID SUBDIVISION, 560.13 FEET; THENCE SOUTH 89°49’11” EAST, ALONG THE SOUTH LINE OF LOTS 82, 74, 73, 72, 65, 64, AND 63 IN SAID SUBDIVISION, 716.75 FEET TO THE SOUTHEAST CORNER OF SAID LOT 63 (SAID POINT BEING ON THE WESTERN LINE OF LOT 9, MONTEREY SUBDIVISION NO. 6, A SUBDIVISION IN THE CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS; THENCE SOUTH 89°49’24” EAST,  ALONG THE WESTERN LINE OF SAID LOT 9, 38.13 FEET; THENCE SOUTH 00°02’25” EAST, ALONG SAID WESTERN LINE, 169.53 FEET TO THE NORTHWEST CORNER OF LAWRENCE BIBLE FELLOWSHIP ADDITION NO 1, A SUBDIVISION IN THE CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS; THENCE SOUTH 00°05’34” EAST, ALONG THE WEST LINE OF SAID LAWRENCE BIBLE FELLOWSHIP ADDITION NO. 1, 350.53 FEET TO THE SOUTHWEST CORNER THEREOF; THENCE SOUTH 89°49’31” EAST, ALONG THE SOUTH LINE OF SAID ADDITION, 621.33 FEET TO THE EAST LINE OF SAID QUARTER SECTION; THENCE SOUTH 00°00’59” EAST, ALONG SAID EAST LINE, 40.00 FEET TO THE POINT OF BEGINNING.  CONTAINS 10.281 ACRES, MORE OR LESS.  SUBJECT TO EXISTING RIGHTS OF WAY AND EASEMENTS.

 

be and the same is hereby changed from that of A (Agricultural) District to RS-2 (Single-Family Residence) District as such district is defined and prescribed in Chapter 20 of the “Code of the City of Lawrence, Kansas, 2003,” and amendments thereto.

 

SECTION III.  That the Zoning Districts Map incorporated by reference in and by Chapter 20, Article 5, Section 501, of the “Code of the City of Lawrence, Kansas, 2003,” be and the same is hereby amended by showing and reflecting thereon the new zoning district classification for the aforesaid tract, as set forth in Section II of this ordinance.

 

SECTION IV.  This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
