RE:

429 Indiana Street, unsafe structure

The City Commission adopted resolution No. 6618 on November 1, 2005, setting a public hearing date of December 20, 2005, for the discussion of the dilapidated house at 429 Indiana Street.  The structure is currently secured with the exception of a broken window (south side of house), however the structure is severely dilapidated.

The owners of record, ROLAND R MUMFORD and MADELINE MUMFORD, are deceased.  Per the attached chronology, I have had contact with Kris Kesinger, acquaintance of William Mumford (son of the deceased owners).  It is my understanding that the estate is in probate, therefore major repair efforts are stalled until ownership is resolved.

This property is within the environs of properties listed on the state historical registry.  However, due to the extent of deterioration of this structure and the attractive nuisance this structure creates, it is my recommendation that a resolution be adopted ordering the property owner to repair or remove the structure within 30 days.  Should the owner fail to accomplish this, the city would have the authority to take necessary actions to remove the unsafe condition, by removing said structure.

Attached are documents related to this property, including a chronology of my contact with this property, notifications and pictures.  Should you have questions concerning this, please let me know.  Thank you.
