Please include the following item on the City Commission consent agenda for consideration at the December 20, 2005 meeting:
UPR-09-03-04, Village Meadows Retirement Community, 17.8 acres on west side of Congressional Drive from W. 6th Street to Overland Drive. Request is for a one-year extension to a Use Permit upon Review, approved by the City Commission on January 11, 2005, subject to 9 conditions. Extension Request is submitted by Paul Werner Architects for Village Meadows LLC, property owner of record.
Per Section 20-1610.1, If no building permit is issued for the site within one year from the date of the Use Permitted Upon Review (UPR) approved by the City Commission, the UPR shall be and become null and void. Applicants may request approval of a one-year time extension if the request is submitted to the Planning Office prior to the original expiration date.
The wastewater service for this project is within the Baldwin Creek 2 Benefit District and would be served by Pump Station 44. The Utilities Department believes there many not be sufficient capacity at Pump Station 44 to accommodate this proposed project at this time, as the development in this area moving forward with construction accounts for over 100% of pump station 44’s capacity. A condition should be added indicating a concern with the potential availability of wastewater capacity to serve the development proposal.
Action Requested: Approval of a one-year extension of the conditional approval of UPR-09-03-04 for the Village Meadows Retirement Community, subject to an additional condition:
Additional Condition No. 10. Provision of the following General Note to the UPR site plan, “Building permits shall not be issued until there is a determination by the Utilities Department that there is adequate wastewater capacity to serve the development proposal.”
