What is Design-Build? How does it differ from traditional construction techniques? Why is it used?
  • Construction & Design Team
  • Differences from traditional design-bid-build
  • Time & Cost savings

Property Acquisition Challenges from Varying Perspectives
  • Legal Challenges

  • Providing just compensation in a shortened time frame
  • Project demands may/will dictate property acquisition schedule
  • Need to assemble a property acquisition team
  • Property acquisition needs can change on the fly
  • Numerous regulatory and legal jurisdictions may be involved
  • Difficult ownership situations/title to property
  • Unforeseen encumbrances

Engineering Challenges & Property Acquisition
  • Unknowns – in the field, easements & encumbrances, topography
  • Time constraints
  • Property acquisition constraints
  • Changes in project design as information is gathered – soil, geotechnical, encumbrances, access
  • Policy constraints, policy decisions
  • Engineering/Construction team can benefit from early involvement of property acquisition team
  • What may look good to engineering team may not be the best option

Appraisal Challenges & Property Acquisition
  • Hurry up and wait – owner wants you on board, but doesn’t know when – exactly
  • Challenges with legal descriptions in a design build project
  • Limited time to meet with property owners due to project time constraints
  • Need to coordinate with all members of the design/build team
  • Project could be awaiting your information
  • Need for speed
  • Get as much information ahead of time as you can
  • Multiple types of takings may be required
11
Acquisition Challenges for the Owner
  • Speed
  • May be lacking precise legal descriptions
  • Preliminary property needs – access for geotechnical work
  • Waiting on design/build team for more precise takings
  • Need to acquire as much property information as possible prior to having property needs in hand – ownership reports, best estimations of property needs
  • Need to prioritize key property acquisitions
  • Work closely with entire design build team from the beginning
  • Shortened time frame for negotiations
  • Need to have the support of governing body, legal team, design build team
  • Communication is key
  • Need to provide budget estimations for the project – can be difficult
  • May need multiple appraisers on board

Lessons Learned
  • Create a property acquisition team from the beginning – PAT, especially with large scale property acquisition needs
  • Seek PAT involvement from the beginning
  • Communicate – timeframes, property needs, deadlines
  • Communicate property specific demands to the design/build team or negotiated deals
  • Be realistic in deadlines
  • Meet with effected property owners early on
  • Frequent project team meetings
  • PAT can provide key insights into design/build solutions
