ITEM NO. 10:         AMENDMENTS TO SECTION 20-403,  DEVELOPMENT CODE (JCR)

 

TA-08-16-07:  Consider amendments to Section 20-403 of the Development Code (Nonresidential District Use Table) to permit veterinary clinics as a permitted use in the IBP (Industrial/Business Park) District.  Initiated by the Planning Commission on August 29, 2007.

 

 

RECOMMENDATION:  Staff recommends the Planning Commission forward a recommendation for approval of the proposed revisions [TA-08-16-07] to Section 20-403 of the Development Code, to the City Commission.

 

Reason for Request:

The Development Code does not permit veterinary clinics in the IBP District which has created a number of nonconforming use situations because such uses were legally established under the former zoning code.

 

 

RELEVANT GOLDEN FACTOR:

  • Conformance with the Comprehensive Land Use Plan is the relevant factor that applies to this request.  Adoption of new regulatory tools, one of which is the Development Code, is an implementation step in Chapter 13 of HORIZON 2020, the City/County Comprehensive Land Use Plan.

OVERVIEW OF REVISIONS PROPOSED

·        The proposed revision would permit veterinary clinic uses, as defined in Section 20-1710 in the IBP (Industrial/Business Park) District.  This use is currently permitted in most other nonresidential zoning districts.

·        According to Section 20-214(a) of the Development Code, the purpose of the IBP District is to provide space in attractive and appropriate locations for certain low-impact employment and manufacturing uses in a planned industrial/business park setting

 

 

CRITERIA FOR REVIEW AND DECISION-MAKING

Section 20-1302(f) provides review and decision-making criteria on proposed text amendments.  It states that review bodies shall consider at least the following factors:

1)          Whether the proposed text amendment corrects an error or inconsistency in the Development Code or meets the challenge of a changing condition; and

The proposed amendment corrects an error in the Development Code.  The previous zoning code permitted veterinary clinics in the M-1 District (former zoning map designation for the IBP District).  This results in such established uses as being considered nonconforming under the Development Code, which had not been the intent upon its adoption.

2)          Whether the proposed text amendment is consistent with the Comprehensive Plan and the stated purpose of this Development Code (Sec. 20-104).

[Section 20-104 of the Development Code states that the purpose of the Development Code is to implement the Lawrence/Douglas County Comprehensive Land Use Plan (Horizon 2020) and other applicable plans adopted by the City Commission, hereinafter collectively referred to as the “Comprehensive Plan” – in a manner that protects, enhances and promotes the health, safety, and general welfare of the citizens of Lawrence.]

The proposed amendment is consistent with Horizon 2020.  The proposed amendment will not negatively impact the health, safety and general welfare of the citizens of Lawrence.
